Find Legal Services While you can file USCIS forms yourself, many people prefer to have legal representation. If you are looking for legal representation, the following are guidelines to keep in mind. An authorized legal representative must be either: An attorney who is: A member in good standing of the bar of a U.S. state or territory, or the District of Columbia, Not disbarred or otherwise restricted in the practice of law, and Eligible to practice law in the United States. or A representative accredited by the Department of Justice’s (DOJ) Office of Legal Access Programs and working for an organization on the DOJ’s List of Recognized Organizations and Accredited Representatives. An authorized legal representative is allowed to: Advise you about which forms to file and when to file them; Give you advice about the correct documents and evidence to submit; Explain immigration options you may have; Help you fill out USCIS forms; and Communicate with USCIS about your case. This list is not exhaustive. For additional information, please visit the DOJ’s website for a list of Recognized Organizations and Accredited Representatives. To help you find an authorized legal representative, the American Bar Association provides information about finding an attorney in your state. The DOJ also provides a list of attorneys who provide immigration services either for free or for little cost. DOJ also provides a list of accredited representatives and recognized organizations. Your authorized legal representative must file Form G-28, Notice of Entry of Appearance as Attorney or Accredited Representative, with the related application, petition, or appeal that you file. USCIS will send information about your case to you and your authorized legal representative if you have one. When choosing an attorney you should: Make sure that the attorney is eligible to practice in – and is a member in good standing of the bar of the highest court of – any U.S. state, possession, territory or commonwealth, or the District of Columbia. Make sure that the attorney is not under any court order restricting their practice of law. Ask to see the attorney’s current licensing document, and verify through the state agency responsible for regulating attorneys that they are eligible to practice. Check the List of Currently Disciplined Practitioners. This is where the Executive Office for Immigration Review lists people who have been expelled, disbarred or suspended from practicing law before USCIS. Attorneys who are on the list and who have a “No” in the last column on the right are not eligible to give you legal advice. If the attorney has been disbarred, but claims they have been reinstated, ask to see a copy of the reinstatement order from the EOIR.

As the summer holidays approach, many families are excited to travel abroad. However, if you're co-parenting, this can sometimes bring challenges. Here's a quick guide from Siân McKernon to help navigate this situation: https://hubs.ly/Q02HWH3C0 The highlights: ✔ Early discussions: Communicate early with your co-parent to ensure smooth holiday plans. ✔ Consent required: If you share care, you’ll need your co-parent's consent to take your child abroad. ✔ Consent letter: Some countries require a consent letter from the non-travelling parent, including travel details and emergency contacts. What if your co-parent does not agree? ❓ Mediation: A neutral third party can facilitate an agreement. ❓ Arbitration: An arbitrator can make a binding decision if mediation fails. ❓ Court: As a last resort, a court can decide on the trip, but this process is lengthy and costly. At Moore Barlow, our experienced family team is here to help with mediation, arbitration, and court applications. Contact us for assistance and ensure a stress-free holiday! #FamilyLaw #CoParenting #HolidayPlanning #MooreBarlow

The other day someone asked me if Ariel's #contract with Ursula is valid. I've never seen the movie. After some digging around on the Internet, the contract is not valid. 1. She was under 18 when she agreed to give Ursula her voice in exchange for legs. I'm assuming that the law of Under the Sea still requires someone to be age of majority to enter into a contract. If she was 18 or older, this part of the agreement would be valid. Most jurisdictions (and by most I mean the one with which I'm familiar) let minors enter into contracts for items of necessity, e.g. food, shelter. Given that she's a mermaid, I'd argue that legs are not a necessity. 2. It is an illegal contract and void against public policy. I had to look up what the deal was. If Ariel didn't get Eric to kiss her within three days, Ursula would own Ariel's soul, i.e. be Ursula's slave. Any kind of contract where one party agrees to be enslaved by the other party is gross, and would never be enforced because it is slavery is outlawed, and even the concept of owning another person violates society's sense of morality. Please keep in mind I am only licensed to practice law in Canada. If you are a mermaid or other sea creature 12 nautical miles outside of Canada's coast seeking legal advice, please consult an Under the Sea lawyer.

Solid analysis of why Ariel's contract in the Little Mermaid wasn't enforceable. Would Ursula have faced criminal charges for enforcing that contract, or is the Sea Kingdom like the 90 countries above the sea where slavery isn't criminalised? However, if King Triton had implemented a Sea Kingdom Modern Slavery Act, Ursula's soul-trading business might have been shut down a lot earlier. Her Slavery and Human Trafficking Statement would have raised a few eyebrows! Working with businesses linked to modern slavery, even unknowingly, is a significant risk. Robust supply chain due diligence can identify these risks early and help to avoid modern slavery in your supply chain. Implementing appropriate clauses in contracts allows businesses to mitigate modern slavery risks, or terminate business/supplier relationships when necessary. It's not just about compliance; it's about building sustainable supply chains for your business. #ModernSlaveryLegislation #SupplyChainDueDiligence #EthicalBusiness

NEW on the Rayden Solicitors' blog - 'Travelling with a Child with a Different Surname: What You Need to Know' by #Hampstead-based Legal Director Jennifer Moore. Agreeing on foreign holidays when you are a separated parent is often tricky, particularly if there are no Court orders in place, and you are the parent with a different surname to your children. Jennifer sets out her top tips for dealing with this situation – the first and most important thing to say is BE PREPARED. We advise all parents to undertake the necessary research and take the required legal advice before travelling; leaving things to the last minute or the week before you travel will undoubtedly make what should be a happy and exciting time pre-holiday, potentially very stressful.
