EOR & Poland, an in demand location right now! What do I need to be aware of to enable a compliant local employment & how does it work? The EOR should have a locally registered entity in Poland A Labour Leasing License (TWA - Temporary workers agreement), to enable the employment of workers being employed on behalf of another company for a maximum period of 18 months. The workers can be placed for up to 18 months with the same employer user within a period of 36 months. There is no restriction in the number of renewals (it is for instance possible to do 18 one-month contracts). 🔎 Following the above requirements, the LL solution dictates that the EOR has an obligation to have a contract and billing relationship directly with the end client/user; controlling and managing the worker. 📜 Contracts must be in Polish, with bilingual versions permitted. 📅 Normal working hours are generally 8 hours per day and 40 hours per week. Overtime is not permitted. 🏥 As per Polish law, workers should conduct occupational health check to make sure they are fit to work. The medical check should be conducted before the start date or else the worker cannot start work. 💵 Invoicing currency and the payroll is run in PLN with requirements to pay the worker in the local currency, alternative invoicing options possible with a currency spread through the supply chain.
