The Adjudication Society held its annual conference last week and many of those there have posted of some of the headlines. One contribution grabbed my attention, that of Costain Group PLC's Matthew Garratt, one of the few users of adjudication at the conference. He was speaking on a panel discussing the perfect decision. Matt has been around the block a few times in senior roles for major contractors and he is a veteran of NEC Contracts®. So we should listen to him when he sets out some of his less happy experiences with some adjudications including; - the adjudicator has clearly run out of time - decision doesn't hang together or make sense - has the adjudicator really understood our point(s)? - mathematical errors - failing to actually reach a decision - lack of subject matter expertise - 'straight down the middle' assessments with little explanation - seemingly random allocation of indiivdual wins/losses that don't bear relation to the underlying issues What should parties do when these types of decision land? I know many ANBs that would want to hear about some of these 'offences'. #adjudication

I can only speak for one ANB - the ICE - but I can speak for it with some authority, since I am the chair of the Dispute Resolution Committee which runs the register of adjudicators, and selects and appoints adjudicators. We crave feedback on our appointments. We have an accessible and robust process for considering complaints about our adjudicators and we are open to feedback - good and bad. It protects the provider of the feedback from castigation (if that is a worry) and protects the adjudicator from sour losers. So please use it and tell us if something like this happens. What not to do is expect it to be as obvious as the problem in the photo in this post!
