These protections went into effect July 1, 2024, removing a tenant’s eviction record from public view and making it illegal for the record to be sold to any third-party company – including credit screening companies. 🏡Eviction filings can have lasting and often permanent consequences for individuals, particularly for low-income and marginalized renter groups. Even when an eviction judgement does not result in displacement, the mere presence of an eviction on a tenant’s public record can hinder their ability to secure safe, stable, and affordable housing long into the future. This can also negatively impact other aspects of their lives, including access to reliable transportation, quality education, and well-paying employment. 👏Under Connecticut’s new eviction record sealing law, an individual’s eviction record will be removed from the court system’s public view within 30 days if the case is withdrawn by the landlord, the tenant wins their case, or the case is dismissed by the judge. Excerpt from the Court of Appeal’s opinion: [T]here is a direct link between the affordability of housing and the supply of housing. Under basic economic principles, prices go up when demand exceeds supply. Thus, the rise in housing prices at every income level in California is logically linked to the insufficient supply of housing at all of those income levels. What is more, the task of ensuring a great supply of housing is one that is logically handled at the state level. That is because local governments are susceptible to “not in my backyard” (or NIMBY) pressure: Local residents do not want to live near high- density housing, so they elect local officials hostile to such housing or lobby heavily against such housing, figuring that some other local government will approve higher-density projects; because local governments would not address the housing shortage if left to their own devices, state intervention is sensible—if not outright necessary. https://lnkd.in/gbszPmf8

Our own Sharon Fitzgerald DiPaolo, Esquire, CRE® was quoted by the Pittsburgh Post-Gazette in an article on the valuation appeals filed in Allegheny County in 1Q 2024: "Sharon DiPaolo, a partner in the Siegel Jennings Co. law firm who specializes in commercial property appeals, said the lower ratio continues to be a big factor in assessment challenges. 'Fresh appeals probably are going to be driven by a significant drop in the common level ratio from last year, she said. Ms. DiPaolo said another factor is 'protective appeals' — meaning those filed by commercial property owners who are still waiting for decisions on 2022 or 2023 appeals. They wanted to make sure that they get the 54.5% ratio for 2024, she said." New Post: 2023 Moultrie County tentative multiplier announced SPRINGFIELD -- Moultrie County has been issued a tentative property assessment equalization factor of 1.0000, according to David Harris, Director of the Illinois Department of Revenue (https://buff.ly/3kpfIYy). The property assessment equalization factor, often called the "multiplier", is the method used to achieve uniform property assessments among counties, as required by law. This equalization is particularly important because some of the state's 6,600 local taxing districts overlap into two or more counties (e.g. school districts, junior college districts, fire protection districts). Forget the public policy behind New York's Good Cause Eviction law, the ramifications of the law on the market, the problem the law tries to address, and the burdens this law is going to put on property owners. If my bubbe were alive today, I am sure the best term she could think of to describe the law would simply be that it is "drek." The legislation serves no purpose and is worthless. It can't even be used for toilet paper. But I digress... Reading the law, it is clear New York State's politicians think so little of the real estate industry. Throughout the law, the legislature wants to make clear that if owners are thinking of loopholes, the legislature has already thought of it (they haven't), and don't even try it (many will anyway), as if the elected officials are parents and property owners are toddlers. For example, there is an exemption for not paying rent, buuuut, the law says you can't add charges just to get around the law. Another example, there is an exemption for small landlords, buuuut, the government doesn't trust you to take advantage of it unless you disclose to the PUBLIC in a filing that lives on the Court system's website forever, any "indirect" beneficiaries. I still don't know what that means, but perhaps the legislature wants you to disclose the names of family member who aren't partners in the deal and any properties your family members own, even though they aren't involved in the subject property. Even putting aside all the issues with the law, the drafting of the law shows a real disdain for the real estate industry. Maybe I'm late to the game, but I can't help but think the government thinks the housing crisis is because of property owners and not because of the short-sighted laws that have been enacted since WWII. #rentregulation #NYCProperty #DHCR #GoodCauseEviction #landlordtenant #housingpolicy

SHELLEY vs KRAEMER was a 1948 US Supreme Court case that ruled that state enforcement of racially restrictive housing covenants is unconstitutional and violates the Equal Protection Clause of the 14th Amendment. The case involved a St. Louis, Missouri neighborhood that passed a covenant in 1911 to prevent African-Americans and Asian-Americans from living there. In 1945, the Kraemers, who owned a home in the neighborhood, accepted an offer from an African-American couple, J.D. and Ethel Shelley, to buy the property. The local HOA sued to enforce the covenant and prevent the Shelleys from moving in. The Supreme Court ruled that while racially restrictive covenants are not void, courts cannot enforce them because this would constitute state action under the 14th Amendment. In September 2021, California enacted Assembly Bill (AB) 1466, authorizing property owners, title and escrow companies, county recorders, and real estate professionals to process a Restrictive Covenant Modification to remove racially restrictive covenants from property records. Here is a 1941 deed from Los Angeles that includes explicit race restrictions.
