The Strategic Role of Risk Register in Progressive Design-Build Projects This month, the Montana Department of Transportation in US published a guide to Progressive Design-Build (PDB) contracts. The document highlights the pivotal role of risk register in PDB projects for managing future changes and minimizing disputes [1]. The report describes the risk register as a collaborative project management tool that necessitates contributions from all parties selected by the owner to deliver a PDB project. It serves as a contractual element to enhance the project’s cost certainty by encouraging non-owner participants to think proactively about project risks and mitigation strategies. For instance, If the non-owner party does not identify a particular risk, that risk will default to the corresponding party, and they may not be entitled to relief. This could put their profit at risk and cause considerable loss. However, for risks identified during design development, if risk events are triggered during construction phase, the non-owner parties will be entitled to compensation or schedule relief. The attached figure, adapted from the report, illustrates the distribution of risks between owner and non-owner parties. As depicted, the owner is accountable for the budget to cover potential change orders stemming from the risk register, while the non-owner parties are liable for risks not recorded in the risk register. This approach to risk management bolsters a project’s cost certainty, safeguards the contractor against unexpected changes in the scope of work, and ensures the owner that the construction costs are not inflated to cover unidentified risks. As mentioned, the risk register is an essential component of PDB contracts, serving as the basis for determining contractors’ entitlements to compensation or schedule relief. Despite its significance, the effort required to establish a mature and comprehensive risk register is often underestimated. For those engaged in the delivery of PDB projects, I encourage you to evaluate the size and the level of engagement of your project’s risk management team.
