The long-awaited amendments to The Body Corporate and Community Management Act will come into effect this year, on Wednesday 1 May. Partner James Nickless has summarised a few of the notable changes below: • A new process for terminating strata schemes based on economic grounds, requiring approval of 75% of all owners, instead of a resolution without dissent; • Clarification of a body corporate’s rights to towing motor vehicles from common property; • Expansion of the definition of nuisance to include unreasonable exposure to smoke drift; • Ability to prohibit smoking on common property as well as courtyards, terraces and balconies; • Further clarity on the requirements for pet by-laws and removing restrictions on size or number of pets; • Changes to disputes within layered schemes.
