WATCH | South Africa marks a significant milestone this year with the 25th anniversary of its #CompetitionLaw framework. To celebrate a quarter-century of #CompetitionEnforcement in the country, we have created a video series (available here: https://lnkd.in/dnExwWBA) as a prelude to the panel discussion and cocktail function we will be hosting at our Cape Town office in just two days (Thursday, 19 September 2024) in honour of this milestone. In the fifth part of our series - #Competition partner, Richard Bhagwan-Bryce, discusses the complexities of #InterimRelief. He discusses how there have been approximately 50 interim relief applications brought to the Competition Tribunal, with the majority having been dismissed. He adds 'The competition authorities have also done excellent work in helping to clarify certain key aspects of section 49 of the Competition Act, being the relevant provision that regulates interim relief applications in South Africa.' LISTEN | There is a distinction between a manager exercising their managerial prerogative in attempting to enforce certain #WorkplaceStandards, and conduct that may amount to #WorkplaceHarassment like coming across as being harsh, bullish, dismissive, or overly critical. In this SAfm interview, #EmploymentandBenefits partner, Sibusiso Dube, answers this question: at what point does such conduct cross the line such that it is regarded as being in breach of a harassment policy? Listen to the complete interview here: https://lnkd.in/diBbvT99
I attended at the SAFM studios last week to talk about my article titled "The thin line between being a bad manager and a bully in the workplace". Access the article here https://lnkd.in/dm4t3R69

EVENT | It has been proven that a demonstrated commitment to #DiversityandInclusion efforts is a key contributor to the success of any organisation. It is with this in mind that the International Bar Association’s Diversity and Inclusion Committee will be hosting a panel of speakers from the legal industry who will share best practice recommendations on implementing D&I policies and integrating these into #OperationalCulture. This panel - which our head of Competition | Kenya, Joyce Karanja, will form part of - will offer practical guidance on managing difficult scenarios and also provide first-hand experiences of implementing the Diversity and Inclusion (D&I) toolkit for Law Firms, which was launched at #IBAParis in 2023. On our #OrganisationalCulture, Joyce Karanja says, 'At Bowmans, we believe that diversity is about people, about the spectrum of differences and similarities of the human experience. These differences whether in race, gender, tribe, nationality, physical ability, background, experience, and way of thinking etc. add to our uniqueness and our individual ability to add value and contribute to the success of the Firm.' When: 17 September 2024, 11:15-12:30 CST Where: #IBAMexicoCity Learn more here: https://lnkd.in/da2CuTXw

EVENT | Last week (11-12 September 2024), the South African Society for Labour Law (SASLAW) hosted its Annual National Conference - which we were a proud sponsor of. This year the overall theme concentrated on the 'Pursuit in the ideal of Justice' which was expectedly delivered by 46 #LabourLaw experts, including our #EmploymentLaw senior associates, Amandla Makhongwana and Sian Gaffney. This #SASLAW event is one of the country's largest gatherings of lawyers and other experts within the field of #labourlaw held with the intention of promoting the advancement of labour law as a legal and academic discipline. Thank you to South African Society for Labour Law (SASLAW) for having us, and to our fellow conference attendees for the insightful conversations. EVENT | Leading law firms have demonstrated incredible resilience in recent years having successfully navigated numerous disruptive events including a pandemic, a global economic recession and trade wars amongst world powers. This #IBA2024 panel will reflect on recent major events, how they have impacted the #legalindusty and the lessons to be learnt from them. On this topic, Ulrike Naumann says 'Leading a law firm through increasingly uncertain times in an ever-changing world is difficult. WATCH | This year, we celebrate 25 years of South Africa's Competition Act and its #CompetitionAuthorities being enforced. To celebrate the introduction of South Africa's competitional regime and the economic #transformation it has achieved over the last quarter century, we have created a video series (available here: https://lnkd.in/dnExwWBA) as a prelude to the panel discussion and cocktail function we will be hosting at our Cape Town office (this Thursday, 19 September 2024) in honour of this milestone. In the fourth part of our series - co-head of #CompetitionLaw, Tamara Dini, and partner, Maryanne Angumuthoo - discuss #AbuseofDominance. Tamara notes that 'Competition authorities are tasked with assessing the practices and conduct of dominant firms', to which Maryanne adds 'It's not the position of dominance and aggressive competition that is frowned upon [by the authorities]. The issue is whether that dominance is abused.’ Watch the complete discussion here: https://lnkd.in/dJCis8yg
