There we were in 2020, merrily going about our business plain language’ing contracts, terms & conditions, policies and whatnot. Then COVID struck and we all started doing online courses to stay sane. Fittingly, some of us took a course in hostage negotiation, while the others settled on a Legal Creatives course on legal design. It was fun (recommended!), and we realised that we were doing legal design all along. If you are also wondering what it is and why it is so awesome, this article is for you! We have been hearing (and writing) a lot about marketers needing your consent before they SMS, email, robocall, and yes, call you. But did you know that they might need your consent to have that information in the first place? If you are marketing using a leads list you have to make sure where you got it from. If you didn't get it from the data subject directly, there are only a few instances when you can collect without consent. Go somewhere else for that. ⛔ Entirely unrealistic Policies. We are not for you if you don’t want to implement your policies. ⛔ We don’t do legal opinions and say they are not. Our opinions actually contain opinions. If you don’t want a legal opinion, ask someone else. ⛔ Boring training. If you don't like to be stimulated, keep away. Expensive data protection compliance projects that have no impact. Not us. No sir/madam.
