About us
We are Australia’s national workplace relations tribunal and registered organisations regulator. Our work directly impacts on millions of Australians every day and the systems we contribute to creating and maintaining are essential to the prosperity and wellbeing of our society. We play a significant role in setting the national minimum conditions of employment and resolving disputes in workplaces. We also aim to support simple, fair and flexible workplace relations through exercising powers under the Fair Work Act. Our organisation consists of Members and Australian Public Service (APS) staff. Members are independent statutory appointees who perform a quasi-judicial role. They make legally binding decisions as part of their role. We have published the Final Report in the Modern Awards Review 2023-24 (the Review). The Final Report finishes the Review, and we will start to conduct a series of cases on our own motion to further examine issues raised during the review. These cases will consider a range of awards including working from home arrangements, part-time employment and other award-specific entitlements. The draft term was prepared following a consultation and submissions process conducted by a Full Bench in May and June this year, and as part of our work to implement Closing Loopholes amendments. From today, 1 July 2024, we have a new ground on which we can issue an exemption certificate. An exemption certificate allows a permit holder to enter a workplace or business premises without prior notice if they are investigating a suspected contravention. We have published the workplace delegates’ rights term to be inserted into all 155 modern awards. Determinations varying the awards will take effect from 1 July 2024. The delegates’ rights term was finalised following extensive consultation and engagement this year and as part of our work to implement the Closing Loopholes amendments. We have also published a fact sheet about the requirement for enterprise agreements to include a delegates’ rights term from 1 July 2024.
