A bill to reform the 𝘗𝘳𝘪𝘷𝘢𝘤𝘺 𝘈𝘤𝘵 was introduced into Australian Parliament yesterday. The reforms are the first tranche arising from the Government’s response to the Privacy Act 1988 (Cth) review and, as foreshadowed in our article last month, the bill includes extensive changes. New civil penalty provisions are proposed for breaches, a new mechanism for governance of offshore data transfers and new requirements for those using AI tools to automate decision making. A new statutory tort for serious invasions of privacy and criminal offences for doxing are also proposed.
