Competition policy is about fairness and keeping market power in check. It encourages companies to offer consumers goods and services that are of high quality, at a fair price and with more choice. It opens doors for new or smaller competitors to take on established players, and to do so on a level playing field. And it sparks efficiency and innovation – crucial factors for the success of the digital and green transitions. Through competition, companies remain nimble and strong. This creates the – big and small – champions that Europe needs to succeed on the global stage. This contributes to more resilient economic growth and fosters employment.   • 🔴 The European Commission has today launched a call for evidence and a public consultation to seek feedback on possible revisions of the Technology Transfer Block Exemption Regulation (TTBER) and the accompanying Guidelines. The TTBER exempts certain categories of technology transfer agreements from the prohibition of anticompetitive agreements in Article 101(1) of the Treaty on the Functioning of the European Union. Its objective is to provide companies with clear and simple rules for pro-competitive technology licensing agreements, thereby facilitating technology dissemination, incentivising initial R&D, and promoting innovation. This initiative forms part of the impact assessment phase, which follows the evaluation concluded in November 2024. The aim of the evaluation was to gather evidence on the functioning of the TTBER and the Guidelines, for the Commission to determine whether it should let the rules expire, prolong their duration or revise them in view of their expiry on 30 April 2026. All interested parties can submit their views in any official EU language on the Commission's Have your Say Portal until 25 April 2025. The Commission will then publish a summary of the feedback received. Input from stakeholders will help the Commission draft the revised rules, with the aim to publish them for consultation in the third quarter of 2025. The impact assessment phase is expected to last until the first quarter of 2026.   • 📣 The European Commission 🇪🇺 has approved, the proposed acquisition of Aluflexpack AG by Constantia Flexibles GmbH. The approval is conditional upon full compliance with commitments offered by the parties. ▶️ The Commission's investigation showed that the parties compete in the supply of flexible aluminium packaging for various end-uses, such as human and wet pet food, dairy and pharmaceuticals, and that the transaction would have reduced competition in the markets for the supply of sterilisable aluminium containers and lids for wet pet food and certain human foods within the EEA. ▶️ To address the Commission's competition concerns, the parties offered to divest the entirety of Aluflexpack's wet pet and human food sterilisable business in the EEA, including all assets and personnel currently part of Aluflexpack's production plant Omial Novi in Omiš (Croatia). ▶️ The Commission will formalise its conclusions on the purchaser in a separate buyer approval process. 🔗 https://lnkd.in/dPy-wWXB 🔗 https://lnkd.in/dVg8xFTJ

  • 📣 The European Commission 🇪🇺 has approved, under the EU Merger Regulation, the proposed acquisition of two vertically integrated paper 📃and packaging 📦 companies, DS Smith plc by International Paper Company. The approval is conditional upon full compliance with commitments offered by the parties, that involve the divestment of five of International Paper's plants in Europe. These commitments fully remove the overlaps between the parties' activities in the corrugated cases markets in North-West France 🇫🇷 and eliminate the overlap in the supply of corrugated sheets in the local markets in Portugal 🇵🇹 and Spain 🇪🇸.   • 🔴 The European Commission finds that Polish public support for chemical company PCC is in line with State aid rules ✔️ ℹ️ In 2012-2013, Poland provided PCC with €16 million in grants and up to €7 million in tax exemptions to invest in a new plant to produce ultra-pure monochloroaceticin in Brzeg Dolny, without notifying the Commission. 🔍 Following a competitor's complaint and an in-depth investigation, the Commission assessed whether this aid followed EU rules. Key findings: 📌 The aid gave PCC a real incentive to invest in Brzeg Dolny, a disadvantaged region; 📌 The total aid amount respected the EU’s regional aid ceilings; 📌 Market conditions supported the investment, with demand looking promising at the time; 📌 The positive impact of the measures outweighed any potential competition concerns.   • 🔴 The European Commission sends Supplementary Statement of Objections to Lufthansa to prevent harm to Frankfurt-New York air passengers ✈️ ℹ️ We have informed the airline about our intention to order the reinstatement of Condor's access to Lufthansa's feed traffic at Frankfurt Airport. 🔍 This is part of our ongoing investigation into the A++ transatlantic joint venture between Lufthansa, United, and Air Canada, and its potential impact on competition on transatlantic routes. Our preliminary findings: 📌 The A++ transatlantic JV restricts competition on the Frankfurt-New York route; 📌 Interim measures are needed to enable Condor to continue offering its services on that route and prevent serious, irreversible harm to competition.
