Most happy to have taken part of this amazing webinar organized by UNECE and WAPPP on SSPPP. For the first time the popular success of over 10 000 Concession user fees in operation at municipal level in France were dissecated from key historical, institutionnal , social ,regulatory, financial and case law angles. The live testimony of the deputy major of a medium size city oultined with examples how in his ecosystem the City manages to plan and develop Concession PPP projects in close contact with the citizens when the city consider, after series of studies and non objections, that this delivery form is preferable over traditionnal procurement and at cost no higher that traditionnal procurement. The developement on the financing approach of the two type of procurement and impact on public debt to gether with adaptation of people needs and affordability and contract resiliency to variety of traditionnal red flag risks risks for the project life cycle where critical to explain the most unusual private sector appetite in France for Concession user fee SSPPP. At this event, we launched the French version of the UNECE Standard on Public-Private Partnerships / Concession Legal Framework in support of the Sustainable Development Goals and its Accompanying Guide. 👉https://lnkd.in/ekyFrgb9 📘This comprehensive Standard provides member States with a complete document that can be easily transposed into their national legislation. Most happy to contribute to this panel on enhancing PPP procurement since an impactful Pf PPP procurement means that the planning and prefeasibility studies have been carried out in accordance with well tested pratices. including series of innovations. I will share my experience in the design of functionnal bidding documents and related objectives which should boil down in serie of key contractual terms de facto similar within same Pf PPP delivery forms and sectors. Then happy to discuss innovative approaches on the content of contract conditions in the tender documents facilitating the procurement process and fostering contract resiliency

Qui savait que la #France avait développé des myriades de #Concessions (PPP à paiement par l’usager) pendant plus d’un siècle avant d’adopter également en partie, au XXIe siècle, le modèle britannique de PPP à paiement public ? Le nombre de PPP à petite échelle #SSPPP appartenant à la famille des Concessions est actuellement bien supérieur au nombre de PPP à paiement public, et cela n’est pas prêt de changer. Le webinaire explorera, à travers des exemples concrets de projets en cours présentés par le maire adjoint d’une petite ville française, pourquoi cette ville a choisi de planifier et développer certains de ses projets de #servicespublics sous le modèle à paiement d’usager (et non sous le modèle de PPP à paiement public). Seront abordés le processus de développement de ces projets, ainsi que le suivi de leur performance et de leur adaptabilité. Le cadre réglementaire et jurisprudentiel facilitant ces nombreux PPP à petite échelle et réduisant les coûts de transaction sera discuté. Who know that France has developed myriads of Concession (user's fee PPP) for over a Century before following in part the in the 21 th Century the UK creation of the Public payment PPP model ? The number of small scale PPP belonging to the Concession family is currently far greater that the number of Public payment PPP and it is not likely to change . The webinar will explore, with concrete examples of current projects presented by the deputy major of a small french City. Why the City has decided to plan and develop some of its public service projects under the user's fee model (and so far not under the public payement PPP model) , the process for developing them, then monitoring performance and adaptability closely. The regulatory and case law framework facilitating those numerous SS PPP and limiting transaction costs will be discussed. Financial sources that private partners are tapping and related organization of the bankability will be specifically adressed . The webinar will conclude with lessons learned, including on ongoing cross fertilisation with some civil law jurisdictions, (specifically in low and middle income countries) , and question on larger replicability of some key features .

Retour sur la conférence organisée par l’Agence Française de Développement et FIN INFRA dans le cadre de Paris Infra Week le 8 novembre dernier   Cette conférence a donné l’occasion à la CEE ONU de présenter ses travaux élaborés par le Centre d’Excellence International sous la direction scientifique de Marc Frilet son secrétaire général. Ce corpus juridique accompagne les pays dans la réalisation de leurs infrastructures publiques tout en respectant les objectifs de développement durable. Bravo à Marc Frilet et toute son équipe d’experts pour ce travail acharné depuis 10 ans et merci à Assiba Djemaoun et Olivier GINEPRO pour avoir eu l’initiative de cet événement et à tous les intervenants pour la pertinence de leurs propos, tout spécialement Tony Bonnici et Gilles Pellissier.   Debrief about the conference organised by AFD and Fin Infra as part of Paris Infra Week on last 8 November   This conference was an opportunity for UNECE Public-Private Partnerships to present the work carried out by the International Center of Excellence under the scientific direction of Marc Frilet, its Secretary General. This body of law helps countries to build their public infrastructure while respecting sustainable development objectives.
