  • Matrimonial disputes involving interests in a business or in assets tend to lead to disagreements about their value. Moreover, the ability to extract funds from a business and understanding the likelihood and quantum of future maintainable earnings is often at the heart of the dispute. At Interpath, our team of valuation and financial experts provides robust independent advice and opinions. • We regularly take single joint expert and party-appointed expert roles. The purpose of a valuation specialist and/or financial expert in a matrimonial dispute is to assist the court in testing the fairness of a proposed outcome from a division of assets and income. • We often act as shadow experts to advise the applicant or respondent on valuation and financial issues. In a mediation or negotiation setting, we can support the efforts of all parties to reach the most accurate conclusion of value. • We have successfully challenged the conclusions of a single joint expert in a Daniels vs. Walker Application.     📣 No DAObt about whether a DAO is a debtor for the purposes of Chapter 15! 🏛 In February 2024, Paul Pretlove FCCA FABRP FIPA and I of Interpath Advisory were appointed as joint receivers over all the assets held by or on behalf of Hector DAO, including assets held within a crypto wallet, for the purpose of collecting in and preserving such assets. 🗽 In a landmark decision, on 15 July 2024, the United States Court has granted the first cross-border recognition of a Decentralised Autonomous Organisation (DAO) under Chapter 15 of the U.S. Bankruptcy Code. This groundbreaking ruling establishes a crucial precedent for the treatment of DAOs in international insolvency cases, reinforcing their legal status as entities capable of being debtors. 📖 1️⃣ 5️⃣ The recognition of a DAO under Chapter 15 is a significant moment in the evolution of digital entities and cross-border insolvency law. This decision not only resolves the question of whether a DAO can be a debtor under Chapter 15 but also signifies a progressive step towards embracing the potential of decentralised technologies within the existing legal framework. As DAOs continue to gain prominence, this ruling will serve as a crucial reference point, shaping the future of decentralised governance and finance and guiding insolvency practitioners in navigating this new terrain. 🥇 Continuing with the trend of crypto firsts by Interpath Advisory (Offshore), not only was the appointment over Hector DAO the first appointment of its kind to date, making it a novel and interesting engagement in the Fintech sector, the recognition of the DAO under Chapter 15 sets further precedents. 🙏 Special thanks to Harneys, Brown Rudnick LLP and Genova Burns LLC for their hard work and assistance on this case.   • Interpath would like to congratulate the BVI National squash team who took home three gold medals in the Junior Caribbean Area Squash Association Championships (Jnr CASA) 2024 on Tuesday, 2 July. Interpath is a platinum sponsor of the event and thrilled with the success during the singles games which saw Delilah Pease winning the first ever gold medal for the BVI in the Championship’s history in the Girls Under 11s. This was swiftly followed by the BVI’s second and third ever gold medals by Jakob Noblett in the Boys Under 13s and Daniel Henderson in the Boys under 17s. Pictured are the three gold medallists with the BVI national team coach, Adam Murrills, and the Honourable Sharie B. de Castro, MHA, Minister for Education, Youth Affairs and Sports. A huge achievement for the BVI and well done to all involved! Interpath is excited to follow these young athletes and their journeys to hopefully becoming future Olympians, representing the BVI.

  • We are delighted to be platinum sponsors of the week-long Junior Caribbean Area Squash Association Championships 2024, starting on Sunday, 30 June. The British Virgin Islands Squash Rackets Association will be hosting the tournament for the first time since 2007 and the competition promises to be one of the islands’ biggest events of the year. The BVI will have its largest representation at a Jnr CASA with 14 players registered to play. The BVI National team includes Oliver Henderson, Danny Henderson, Zevieh Abraham, Ethan Mohamed, Lilly Smit, Joshua Noblett, Jakob Noblett, Zivon Abraham, Rylan Smit, Emily Jackson, Ashton Starkey, Devon Mellor, Delilah Pease and Leela Mellor. The tournament expects to see just under 150 players compete across Under-11, Under-13, Under-15, Under-17, and Under-19 age groups within singles, doubles and team events. The players will be supported by 50 to 100 coaches, parents, and family members. The tournament will be hosted at the Tortola Sports Club, which has around 500 members out of the islands’ total population of over 31,000. In the BVI, we are lucky to count among us some very successful squash players, including Adam Murrills (BVI National team coach and former PSA world number 76), Joe Faragher-Kneipp (former PSA world number 10 and Commonwealth Games Gold medal winner) and Joe Chapman (former PSA world number 97). The BVI Olympic Committee President, Ephraim Penn, will be attending and speaking at the opening and closing ceremonies of the tournament. Invitations have also been extended to Natalio Wheatley, the BVI Premier and Sharie de Castro, Minister for Education, Youth Affairs and Sports, to also attend and speak at the opening and closing ceremonies.   • Earlier this month, the Crypto Fraud and Asset Recovery Network (CFAAR) and Walkers held a panel discussion using Cayman Islands foundation companies as legal wrappers for DAOs.
