🚀 New Resource Alert! 🚀 We're excited to announce the release of our latest research: "Available Judicial Pathways: A compare-and-contrast analysis of ten jurisdictions in the European Union". Despite the EU Charter’s strong potential to protect digital rights and the Court of Justice of the EU’s active role in applying these protections, national-level legal practice often defaults to more general rights in national or international frameworks. Our report explores viable legal pathways available in 10 jurisdictions: Germany, France, Belgium, The Netherlands, Italy, Greece, Croatia, Spain, Portugal, and Ireland, and highlights where and how the EU Charter can play a stronger role in national contexts. This report also ties into our recent work on collective redress mechanisms, providing a holistic view of EU digital rights protections. ➡️ Download the full report here: https://lnkd.in/e-xZeBwx 🖼 Artwork: Kruthika N. Earlier this year, we hosted our first law clinic through a series of online sessions between experts and clinic participants. As part of the digiRISE project, funded by the EU CERV Action, we brought together experts and participants from all over Europe to dive deep into the EU Charter of Fundamental Rights, focusing on crucial issues like privacy and data protection in the digital age. The goals of our law clinic: ✅ raise awareness of the Charter’s relevance for protecting digital rights; ✅ improve knowledge of judicial pathways to enforce digital Charter rights; ✅ promote the use of collective redress mechanisms to protect digital Charter rights; ✅ provide participants and experts with the opportunity for mutual learning. The response has been great! Participants found the sessions insightful, and our experts enjoyed the flexibility and collaboration. We’re excited to keep building on this and host more clinics soon! If you’re thinking about setting up your own clinic or want to learn more, reach out at alexandra@digitalfreedomfund.org. ➡️ Read the full blog about the law clinic here: https://lnkd.in/e9_HPdqm

Our Co-Director, Nikita Kekana, and Legal Officer, César Manso-Sayao, hosted a session on Strategic Litigation Reimagined for Justice at Team CommUNITY's #GlobalGathering on 27 September 2024. Together with participants working on various digital rights issues, we strategised how the digital rights community can prioritise and fund legal cases that centralise the needs of communities most impacted by digital rights violations from an intersectional approach. Thank you to Team CommUNITY for having us and to all the participants for engaging and sharing their digital rights cases.

Read our latest blog post by Alice Giannini from one of our grantees StraLi for strategic litigation. Alice has written about StraLi's pre-litigation research on facial recognition technology used by police in Italy. https://lnkd.in/erBQSN4u

In a blogpost just published on the Digital Freedom Fund's blog I reflect on StraLi for strategic litigation's work on law enforcement and facial recognition technologies in Italy (specifically on SARI, “Sistema Automatico Riconoscimento Immagini”). Due to a persistent lack of information civil society representatives struggle to even grasp the magnitude of the phenomenon. Are law enforcement agencies using SARI Enterprise on a daily basis during their investigative activities? Or is this a niche activity? Do officers receive special training in order to learn how to use SARI and to interpret its results? We, as civil society representatives, are (almost) in the dark. That is why even small bits of information, such as statistics on the number of searches conducted, are beacons of light. Moving forward, we would like to continue working on this issue and we are currently working on our next steps. Our search for “the” case to litigate continues and we welcome any input from stakeholders who may have insights or relevant information to share.
