On 1 September 2024, a substantial reform of the EU litigation rules entered into force. The reform exists, amongst others, in (i) the transfer of jurisdiction from the European Court of Justice to the General Court of Justice of the European Union for certain preliminary reference procedures, (ii) transparency-enhancing procedural changes for preliminary reference procedures and (iii) the extension of the current mechanism to exclude appeals to the European Court of Justice of the European Union. Diederik van der Kooij, Phebe Franssen and Aimée de Goede investigated the current and future class action developments in Israel in collaboration with Noam Zamir from S. Horowitz & Co. Israel has the largest number of class actions per capita worldwide. Class actions have in principle an opt-out mechanism and allow for monetary damages. They can be brought by a representative claimant and under certain conditions by non-profit organisations and some public authorities. Most class actions are resolved either by settlements or consensual dismissal. Both must be approved by the court in order to protect the interests of the class members. Portugal has a well-established tradition of class actions on an opt-out basis. Nadir Koudsi and David Hakhoff investigated the current and future class action developments in Portugal in collaboration with Mariana Soares David, Sofia Vaz Sampaio and Gonçalo Andrade e Castro from Morais Leitão. In comparison with other jurisdictions, Portuguese courts are not very demanding when assessing claimants’ procedural legitimacy in class actions. Moreover, claimants in class actions are exempt from paying initial fees or in some cases even from all court costs. This has contributed to Portugal's popularity for filing class actions. The Act that transposed the Representative Actions Directive (RAD) came into force on 6 December 2023. It provides for an opt-out system for representative actions that fall under the RAD’s scope and regulates third party litigation funding for actions for redress measures. Isabella Wijnberg, Clark Warren and Caroline Devès investigated the current and future class action developments in Ireland in collaboration with Richard Willis from Arthur Cox LLP. Ireland did not have a general class action mechanism in place before the transposition of the Representative Actions Directive (RAD). The only mechanism available was limited and rarely used. The Act that transposed the RAD entered into force on 30 April 2024. It provides for an opt-in representative action for consumers, brought by pre-designated qualified entities. Third party litigation funding is currently prohibited, but a reform is being discussed. In October, we are holding an interactive seminar where the main results of this research will be presented. Nadir Koudsi and David Hakhoff investigated the current and future class action developments in Spain in collaboration with Irene Arévalo González from Gómez-Acebo & Pombo. Spanish class actions are currently regulated in different laws that are somewhat fragmented. The Representative Actions Directive has not yet been transposed. However, the current draft transposition bill creates a coherent system for injunctive and redress measures, including declaratory relief. It also includes a section on court-approved class settlements. Although not qualifying as class actions, mass litigation has increased substantially in Spain in recent years.
