Diamond Shruumz products have been linked to an ongoing outbreak of illness by the FDA and CDC. Here’s what we know so far and how to stay safe: - Diamond Shruumz’s Amanita muscaria products have been linked to 175 cases of illness and potentially three deaths since September 2023. - Lab testing has shown psilocybin, psilocin, DMT, kratom and many other chemicals in products from Diamond Shruumz and other manufacturers. - The cause of the illness has not yet been determined, but it is likely caused by multiple substances, with muscimol and psilocin being the most likely culprits. - The edible mushroom market is much like the early days of the delta-8 THC market, with little oversight and companies attempting to cash in on the mixture of customer interest and the lack of regulation. - Consumers are advised to avoid any edibles promising a psychedelic experience. At a bare minimum, products should have a recent lab report from a reputable lab showing exactly which compounds create the advertised experience. Psychedelic experiences can expand your mind in a way very little else can. You can have profound, eye-opening experiences that positively reframe your view of yourself and the world around you. A new report advises federal agencies to step up cannabis-focused public health measures, including placing hemp THC back on the controlled substances list. Overall, the report offers many good suggestions for improving cannabis policy, and while we see the hemp recommendation as a misstep, there is a lot of value in the report. The 4th Circuit Court of Appeals ruled that hemp-derived THC-O is legal provided it contains no more than 0.3% delta-9 THC, rejecting the DEA’s arguments. We asked cannabis attorney Rod Kight about this: “Yes, this opinion carries significant weight. […] [T]he 4th Circuit went out of its way to address THC-O and hemp compounds. It didn’t have to address THC-O or hemp compounds at all in order to support its opinion. The fact that it did address the hemp issues at length, particularly on a case of first impression, signals that the court wanted to make a point about the legal status of hemp compounds.” Phil Dixon, Director of Public Defense Education at the University of North Carolina, commented: “This all means that yes, THC-O, when not otherwise exceeding the delta-9 THC concentration, is legal as a matter of federal law within the Fourth Circuit. The DEA can continue trying to enforce its interpretation in other circuits where the issue hasn’t been decided, but they won’t win on that argument in this circuit.”

The DEA has announced a hearing on December 2nd to discuss the proposed rescheduling of cannabis, likely delaying any change into the next presidential term. It’s likely that groups like Smart Approaches to Marijuana will be prominently featured alongside pro cannabis advocacy groups on December 2nd, and that both groups will largely hit on the same points they did in the comment period. This all raises the question: how will verbal presentations of the same arguments make a difference? Are we expecting some new, bombshell studies to settle these issues in the coming three months? The truth is, this is a big move that the DEA likely doesn’t feel so great about, and as Vince Sliwoski said, the hearing will help “insulate its decisions” from blowback by drawing out the process. The rescheduling will likely go ahead; it will just take longer than it needs to. Delta-8 THC products always contain unintended byproducts and sometimes even unknown ones, so are customers at risk? ❗The cyclization reactions used to make delta-8 THC from CBD can (and generally do) lead to unintended byproducts like iso-THCs and even molecules never before encountered. 🔹 We do not know if these components are dangerous, but any conclusions about risk drawn from the FDA’s adverse event reporting system (FAERS) or calls to poison control centers are probably misleading. 🔹 Producers could use chromatographic purification (or even truly “synthetic” production methods) to minimize the risk, but this would increase costs for them in a way they are apparently unwilling to do. 🔹 Customers should be wary of delta-8 THC products, but it’s crucial to remember that for many people, there is no other option to get high legally. Solutions that ignore this are not solutions at all. “Producers know that these contaminants are present, and actively seek out labs that do not, or will not report these compounds. Is it incompetence? Ignorance? Malfeasance?" "There is certainly a chance. We have tested 1000’s of these products, and to date, have not found one to be without contaminants. It is not unusual to find 30 or more unidentified chemical compounds, many of which do not exist in nature [like 4(8)-iso-THC], for which no toxicity information exists. We do not know if iso-THC is dangerous or not. It could be the next big cancer drug, or it could be the next big cause of cancer. A new study has found that smoking cannabis could more than triple your risk of head and neck cancer, but there are some crucial details not captured by the headlines. "An important takeaway is that our research reveals individuals who use cannabis, particularly those with a cannabis use disorder, are significantly more likely to develop head and neck cancers compared to non-users. This finding underscores the potential health risks of cannabis use, which may be similar to those associated with tobacco smoking, as both involve inhalation of smoke containing carcinogens." - Niels Kokot, Keck Medicine of USC "The study reports a significant association between cannabis-related disorders and certain head and neck cancers, such as laryngeal and oropharyngeal cancers. We’ve analyzed the results from 70 polls to answer some of the key questions about the fight for cannabis legalization in the US. Here’s what we found. - Support for cannabis legalization has increased over the last 10 years, from 53% in 2015 to 62% in mid-2024, peaking at 71% in the first half of 2022. - Democrats, independents, and younger adults (under 45) are more likely to support legalization than Republicans and older adults. - Florida’s recreational legalization ballot initiative in November is likely to be a close call. Polling from 2024 altogether suggests it will fail, at 57% support (short of the 60% needed). However, the most recent polling from June suggests it will pass. - The recreational cannabis ballot measure in North Dakota is not likely to pass based on polling conducted to date, but the one in South Dakota could go either way. - If Nebraska’s medical marijuana ballot initiative is approved, the only poll from 2024 suggests it will pass comfortably.
