You may have seen that a U.S. District Court ruled against USDOT's DBE program last week. The decision stems from one of multiple federal lawsuits filed in the wake of the Supreme Court’s 2022 ruling on affirmative action. The Equity in Infrastructure Project remains steadfast in our belief that helping more small businesses grow and create jobs is good for our country. As the Washington Post noted in covering the ruling, "John Porcari and Phillip Washington, chairs of the Equity in Infrastructure Project, said that while the DBE program helps women- and minority-owned businesses compete for contracts, the public also benefits when there is more competition in the bidding process." That competition, along with building generational wealth and reducing the racial wealth gap, saves taxpayer dollars and improves contractor performance. EIP will continue to closely monitor this case as it proceeds through the courts. In addition, we are convening our coalition to discuss the case, similar cases and next steps for EIP. It is important to note that this ruling only applies to the two firms that filed the suit and the contracts they bid on. USDOT has stated, "As the case moves forward, we will continue to defend the program. In the meantime, we will comply with the court's ruling, and the program otherwise remains in effect." We also remind you that the EIP Pledge is a voluntary moral and ethical commitment, which allows our coalition to make progress regardless of the legal landscape. How ever this case or others like it are ultimately ruled on by the courts, public and private sector leaders can continue their work to increase competition for infrastructure contracts through EIP. https://lnkd.in/gwG4GhGH  

🎥 Los Angeles World Airports, Unibail-Rodamco-Westfield Airports, and Delta Air Lines celebrate local, minority-owned business participation milestone at LAX Terminal 3. These milestone reflects LAWA and URW’s commitment to diverse, inclusive airport concessions. It raises the bar on local, minority and female-owned business participation at LAX by including 22 minority business owners working together to deliver the best guest experience for Delta’s customers. The new program is expected to achieve Airport Concessions Disadvantaged Business Enterprise (#ACDBE) participation of 43% for food and beverage and 36% for retail, outperforming the 25% and 20% project goals. “Today’s celebration of LAX Terminal 3’s new dining and retail offerings is a testament to LAWA’s commitment to fostering a diverse and inclusive environment,” said Eboni Wimbush, President & CEO, Airport Minority Advisory Council (AMAC). “By partnering with Unibail-Rodamco-Westfield and Delta Air Lines, LAWA not only elevated the passenger experience but also empowered local and minority-owned businesses, many of whom are AMAC members. With 22 minority business owners contributing to this dynamic new space, we’re proud of LAX exceeding its ACDBE participation goals and setting a new standard for airport concessions nationwide.”

We remember and honor the legacy of the 2,977 victims who perished on September 11, 2001 in New York, Virginia, and Pennsylvania. We are grateful to the first responders, and the men and women in public transportation who bravely evacuated thousands and then worked to rebuild.
