Texas Small Business Owners! A recent court order has temporarily blocked the new DOL overtime rule for government employees in Texas, but this ruling does not apply to private employers. If you run a small business in Texas, it's crucial to understand and comply with the new regulations. As of July 1, 2024, the salary threshold for white-collar exemptions under the Fair Labor Standards Act (FLSA) has increased from $35,568 to $43,888 annually. This means employees earning below this threshold must be paid overtime for any hours worked over 40 in a workweek. Two significant updates in the HR landscape this past week   1. New Federal Overtime Rule: The U.S. Department of Labor (DOL) has made a crucial decision this week regarding the salary threshold for the "white-collar" exemptions. Starting July 1, the threshold will rise from $35,568 to approximately $43,888 (annually). Furthermore, this threshold is set to increase to nearly $58,656 as of the beginning of 2025 and will automatically update every three years. This means your workers will need to earn at least this new threshold to even be considered exempt from OT pay under the white-collar exemptions. Now is a good time to review your exempt jobs for compliance will all criteria – not just the salary threshold. 2. FTC Ban on Non-Competes: In another significant move, the Federal Trade Commission (FTC) has voted to prohibit non-compete agreements for nearly all employees and employers. This decision comes with the understanding that existing non-compete agreements will be deemed unenforceable, except in cases involving senior leadership, and that employers are to provide notice to current and former workers that their non-competes are no longer valid. The ban is set to go into effect in 120 days. However, it's essential to note that the ruling is already being challenged in court, possibly derailing or dismissing the decision all together.
