We're proud to launch our new film telling Mighty Earth's story of how we deploy our "perfect storm" campaign approach to stop the destruction of nature and shift whole industries to adopt sustainable practices. We use several strategies, from satellite monitoring to pinpoint deforestation in supply chains to scrutinising companies to see if they're “greenwashing” their climate and ESG credentials. Our reports and investigations have revealed that many industries still don’t have control of their supply chains, allowing deforestation and human rights violations to seep in through direct and indirect suppliers. We work alongside Indigenous communities on the frontline of deforestation, amplifying their voices and seeking new platforms for their stories to be heard. The European Commission issued an update on the EU Deforestation Regulation (EUDR), in which it announced it was proposing a 12-month delay to the implementation of the law. This move is potentially disastrous for the world’s forests, and Mighty Earth strongly condemns the Commission for bowing to pressure from some governments and regressive industry bodies, when millions of euros and tens of thousands of hours had been spent by people, companies, governments, farmers and others who were readying themselves for EUDR compliance. At a time of growing Nature and climate crisis, including fires engulfing much of the Amazon, this decision shows an absence of political leadership. JBS’ plans to list on the NYSE faces further scrutiny from investors and NGOs. Eighteen investors, representing US $22.2 billion in assets under management, have co-signed a letter to US Securities and Exchange Commission U.S. Securities and Exchange Commission EC Chair Gary Gensler, raising serious concerns over JBS environmental reporting. In parallel 20 leading NGOs have released a new briefing for investors, outlining key risks in JBS’ renewed SEC application. Analysis of JBS Initial Public Offering (IPO) application reveals the company removed references to ‘zero tolerance’ to the invasion of protected areas, including Indigenous lands and environmental conservation zones. This omission has sparked serious concern, given that as recently as September of this year, Mighty Earth found, JBS was reportedly linked to the invasion of Indigenous lands in Brazil and deforestation of over 18,000 hectares of land in the Amazon and Cerrado ecosystems. Further concerns for investor and the SEC, outlined in the briefing, highlight JBS’ liabilities from criminal, civil and other legal proceedings increased substantially from $1.7 billion in July 2023 to $3.6 billion in June 2024. This figure failed to include estimated penalties related to the State of New York case brought against JBS USA for an allegedly ‘unsubstantiated and misleading’ Net Zero 2040 target. JBS S.A. was delisted by the Science-Based Targets initiative (SBTi) for failing to submit a climate plan, despite its continued Net Zero 2040 claims. "Delaying the EU Deforestation Regulation is like throwing a fire extinguisher out of a burning building." EU President von Der Leyen has given into pressure from a handful of deforesters and proposed postponing the law. This is perhaps the most important international forest policy of the last decade. Now, while South America's forests are burning and serious new threats are emerging to Asia's forests, one of the best tools to stop them is being jettisoned for now. There is some intentional sabotage here - she has not released the guidance that provides companies with the details that can help them comply. And as our recent webinar showed, everyone from smallholder farmers to the bulk of responsible companies were ready for EUDR compliance. A few giant animal feed and Canadian forest companies moaned that even while rubber, palm oil, and cocoa farmers making as little as a few hundred dollars a year could comply, they couldn't figure it out - but that was just normal lobbyist moaning that shouldn't have gotten the traction it did. But at a deeper level, this setback is a product of much of the funding for the environmental community going towards technical compliance issues - while agribusiness was putting angry farmers in the streets. There's been great work by Fern NGO and many civil society allies in Europe and around the world, but it needs to happen at scale commensurate with the challenge and opportunity, and especially focused on EU member state governments. We need to scale up high-level lobbying, grassroots advocacy, and communications. The good news is that I think this really is a delay rather than an underhanded cancellation. So there's a chance to do that quickly. That doesn't mean there aren't threats. The EU could in its postponement also weaken the regulation further. Traceability and transparency are the first step towards sustainable supply chains. On the most recent episode of BBC Radio 4’s The Food Programme with Leyla Kazim, Thea Parson, Senior Climate & Forests Associate at Mighty Earth, uncovers the mystery behind the cashew nut industry. If you look at a packet of cashew nuts in the supermarket, the label will often say “mixed origin”, leaving consumers with little information on where their nutritious snack came from. We know that supply chain traceability is the first step towards sustainability. Publicly sharing this information is the next.
