For the first time in over a decade, NYSDEC proposes to update Commissioner’s Policy 51 (CP-51), which sets forth the soil cleanup levels for the NYSDEC Division of Environmental Remediation’s remedial programs. NYSDEC is currently accepting written public comments on the proposed CP-51 revisions until 5 p.m. on September 26, 2024. Once effective, the CP-51 revisions will, among other things: ◾ add soil cleanup guidance values for PFOA and PFOS; ◾ establish certain “presumptive remedies” for PCBs; ◾ supplement the existing definitions of “grossly contaminated media” based on elevated concentrations of PAHs; ◾ modify and/or eliminate certain supplemental SCOs and petroleum-related unrestricted SCOs; and ◾ refine the criteria used to evaluate the potential degree of public health or environmental concern when SCOs are exceeded. The rapid emergence of generative artificial intelligence tools is challenging environmental lawyers, consultants and government agencies to determine when and how these tools can be responsibly integrated into their practices. The American Bar Association's Formal Opinion 512, issued in July, underscores this necessity by providing guidance on how to navigate the ethical responsibilities associated with using AI tools. On July 1, 2024, the Council on Environmental Quality’s (CEQ) final rule implementing the revised National Environmental Policy Act (NEPA) Phase II regulations came into effect. This rule, marking the final phase of the Biden Administration’s effort to update the 2020 amendments to the NEPA regulations, reintroduces critical environmental policies and establishes new requirements for more robust and streamlined environmental analyses. 2024 has already been a banner year for the regulation of per- and polyfluoroalkyl substances (PFAS) at the federal level. US Environmental Protection Agency (EPA) recently listed perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS) as hazardous substances under CERCLA, promulgated new drinking water standards for PFOA and PFOS under the Safe Drinking Water Act, and proposed to list several other PFAS compounds as hazardous constituents under RCRA.
