Artificial Intelligence (AI) has become a widely discussed topic. The United States Patent and Trademark Office (USPTO) has been actively considering the use of AI tools by parties and practitioners. On April 11, 2024, the U.S. Patent and Trademark Office (USPTO) published guidance to the Federal Register on the use of AI tools in matters before the USPTO. The guidance acknowledges that AI may be beneficial to practitioners in preparing and prosecuting patent and trademark applications but notes there are risks associated with the use of AI and cautions that practitioners must be careful to adhere to the USPTO’s existing rules and policies when using AI assistance. The guidance outlines how the existing rules and policies apply to the use of AI tools and includes examples of acceptable and unacceptable use for both patent and trademark practitioners. Today the Director of the U.S. Patent and Trademark Office released a memo on misconduct by parties and practitioners using artificial intelligence (AI) before the Trademark Trial and Appeal Board (TTAB) and Patent Trial and Appeal Board (PTAB). The Director discusses the increasing use of AI by parties (including self-represented individuals) and practitioners and expresses confidence that the current rules at the agency are sufficient to handle the challenges arising from AI usage that the USPTO is likely to encounter. In particular, the requirements in existing rules apply regardless of how submissions are generated. For example, the Director cites USPTO's Rule 11.18, based on Federal Rule of Civil Procedure 11, that states inter alia "[a]ll statements made therein of the party's own knowledge are true." The Director also announced that the USPTO will be publishing a notice in the Federal Register with more guidance to the public concerning USPTO's existing rules and their applicability to the use of AI tools by parties and practitioners.

This weekend I was thinking about how AI can be used in various phases of patenting, from ideation to drafting a patent. So, I started searching on the topic and found this interesting article: https://lnkd.in/ginKU_uf Here are a few key points: · "If an AI tool is used in drafting or editing a document, the party must still review its contents and ensure the paper is in accordance with the certifications being made." · "If the use of an AI tool is material to patentability (for example, if AI came up with additional claims), the use of the AI tool must be disclosed to the USPTO." · "Only “users” are permitted to file documents or access authorized information and AI systems or tools are not considered a “user” and cannot file and/or access documents via the USPTO’s electronic filing systems." · Location of the AI servers outside the U.S. and even allowing access to the U.S.-based AI servers to non-U.S. persons can introduce export and security issues.
