I’m very fortunate that my organisation provide private healthcare as part of my benefits package 💕 ONLY On closer inspection (2 hours review in my own time) it’s seems the provider has excluded BASICALLY EVERYTHING related to: 👉 Pregnancy 👉 Childbirth 👉 Women’s health in general by the looks of it… So what’s my call to action? Clearly, one size does not fit all when it comes to employee benefits (assuming you employ women) ✅ Please challenge your organisation to consider the differing needs of women employees so benefits are truly inclusive. Did the thought of updating your HR policies top your list of New Year's resolutions as the clock struck midnight? While it might not have been the first thing on your mind, it's actually quite important! If it's been a while since you last updated your policies, there's a good chance they could be out of date or lacking formal guidelines for certain situations. It could also mean that you’re not keeping up with (or getting ahead of) the competition when it comes to benefits for your employees. There are policies that will inevitably need updating or adding too, such as compassionate leave and pregnancy loss. Since there is no legal requirement, it’s down to you to ensure you not only have your employees’ best interests at heart, but that you also protect your business from tribunals or other proceedings. Even if you’ve never needed these policies before, it’s wise to be prepared rather than scrambling one together in a crisis. As your business expands and your team grows, the likelihood of facing such situations only increases. UNDERSTANDING MENOPAUSE AND UK EMPLOYMENT LAW: THE IMPACT AND LEGAL OBLIGATIONS Menopause can significantly affect women in the workplace, and it's crucial for employers to understand their legal obligations to support those experiencing menopausal symptoms. The Impact of Menopause at Work Recent research by the Chartered Institute of Personnel and Development highlights that two-thirds (67%) of working women aged 40 to 60 who have experienced menopausal symptoms report a mostly negative impact on their work life. Key findings include: • 79% reported decreased concentration. • 68% experienced increased stress. • 49% felt less patient with clients and colleagues. • 46% felt less physically capable of carrying out work tasks. Consequences in the Workplace Due to these challenges, over half of the respondents could recall instances where menopausal symptoms prevented them from attending work. Furthermore, research by the Fawcett Society reveals that one in ten women surveyed left their jobs due to menopause-related issues. Legal Obligations for Employers Menopause symptoms can be classified as a disability, and employers may face legal action if they fail to make "reasonable adjustments." The Equality and Human Rights Commission (EHRC) has issued guidance to help clarify employers' legal obligations regarding workers undergoing menopause. Interesting highlights in the regulations include: Examples of reasonable accommodations, such as additional breaks for hydration, meals, or restroom use; offering a stool for sitting during work; allowing time off for medical appointments; temporary reassignment of duties; suspension of certain tasks; telecommuting; or leave for recovery from childbirth or miscarriage, among others. Guidance on limitations and medical conditions eligible for reasonable accommodation, such as miscarriage, migraines, lactation, and episodic pregnancy-related conditions like morning sickness. This guidance aligns with the Pregnancy Workers Fairness Act (PWFA), Title VII of the Civil Rights Act of 1964, and relevant court rulings. The importance of early and open communication between employers and employees to address reasonable accommodation requests promptly. Clarifying that employers are not obligated to request supporting documentation for accommodation requests unless deemed reasonable under the circumstances. Defining when an accommodation may pose an undue hardship on the employer and operations. Information on how employers can assert defenses or exemptions, including those based on religious beliefs, as early as possible in the accommodation process. #DEI-B #PWFA #EEOC #workplace
