Commissioner Gomez and Wireless Infrastructure Association President and CEO Patrick Halley met with our teams, received an overview of Congruex, and learned about our wireless and fiber work. They also heard about our commitment to safety and training through TIRAP: Powered by WIA, where registered apprentices learn and grow while deploying wireless and fiber broadband networks. THE ‘MODERN DAY’ BOUNTY HUNTERS Yes..they are here... in our lives every minute of every day, watching and waiting to pounce on YOU! We lose circa 25 electrical engineers a year who die from Shock or Arc Flash... with scores more suffering career changing injuries....and if you have not put in place, what the HSE will demand from you after the event, (they do suggest prior, but it is so ambiguous, you will not know it).. Just spotted this at 20:30 on Radio 4 tonight on HS2. Should be an interesting listen. What would Isambard Kingdom Brunel have done? It's 2024, and the Manchester extension of HS2 has been cancelled. The leg to Leeds was cancelled in 2021. The remaining line to Birmingham is now less than half the initial planned route, and will cost over double the initial budget. This is not exclusive to HS2; Sprialling costs and missed deadlines have become commonplace in big engineering projects, the UK is now one of the most expensive places in the world to build infrastructure, but Britain has a proud history of engineering, and one name in particular looms large - Isambard Kingdom Brunel. In Springfield City Group Pty Ltd v Pipe Networks Pty Ltd [2023] QCA 172, the Court, (Bowskill CJ and Morrison and Flanagan JJA) dismissed the appeal relating to the construction and maintenance of a "duplicate" fire optic network by upholding the primary judge's interpretation of the underlying contracts, and application of the torts of trespass and conversion. SLC is the owner and developer Springfield in south east Queensland. In November 2005 it entered into two agreements with PIPE for the installation of a fibre optic network between Brisbane CBD and Springfield CBD. In 2008 construction was completed. In July 2009, PIPE decided to install its own "duplicate" fibre optic cable network in the same pits and those which accommodated SLC's network. In 2011, SLC discovered that PIPE had underpaid it for revenue generated by the "original" network. It commissioned an audit which discovered the duplicate network, and identified that since August 2009, PIPE had been connecting customers to the duplicate network, not the original. SLC commenced proceedings against PIPE for breach of contract, trespass, and conversion. The primary judge dismissed the claim. SLC appealed. The appeal was dismissed. The Court held that the primary judge did not err by failing to find a "non occupation" or "non-compete" term in the agreement. No such express term existed and the argument that the terms should be implied did not meet the Codelfa tests. It also disagreed with SLC's arguments concerning the ownership of certain infrastructure associated with the original network. Finally it dismissed trespass and conversion claims because it was not proven that PIPE utilised parts of the original network to create the duplicate network, or that any interference by PIPE was intentional.
