Given the stakes for everyone concerned, bad faith litigation is often contentious, and it is frequently characterized by discovery disputes. The parties may battle over the discovery of insurance company claims manuals, reserve information, the insurer’s communications with coverage counsel, various attorney-client privilege questions, claims professionals’ employment records, adjusters’ understanding of the law, reinsurance information, claims supposedly similar to the one in question, other bad faith claims against or litigation involving the insurer, the insured’s conduct in allegedly “setting up” the insurer for a bad faith claim, and more. This panel of experienced insurance lawyers will examine these complex issues in practical fashion and analyze them from both insurers’ and policyholders’ perspectives. In my latest Schiffer on Re-Insurance Blog post I discuss a reinsurer's audit rights and a case in which a court had to address the scope of the audit.

To an underwriter for professional indemnity insurance, the term "professional" encompasses various services such as engineering, legal, tax, and financial services, among others. When a company assigns an unqualified and therefore incompetent individual to manage these critical services, it inevitably leads to the loss of qualified talent and hampers day-to-day business activities. In such circumstances, it is unreasonable for management to expect local staff to perform better, as this constitutes a clear double standard.  Top management must lead by example, as accountability begins at the top.
