In Pakistan's penal law, issuing a false cheque is a non bailable offence, codified in s. 489-F PPC, which means bail is not a statutory right and can be granted under some conditions. One of these exceptions is 497(2) of Pakistan's Criminal Procedure Code which says, in essence, that the bail can be granted if at the bail stage the evidence available to court would not be prima facie sufficient to put the accused behind bars or "requires further inquiry." s. 497(2) CrPc. 489(F) has two ingredients: obligation i.e. a loan obligation ; (ii) dishonored cheque attempted to satisfy this obligation. These principles were tested in our recent bail application. Although the cheque was dishonored, the obligation as alleged by the complainant is that the accused, a Karachi resident, took PKR 1.14 crore of solar panels from NawabShah from the complainant. This statement had two problems: (I) why would a solar dealer purchases solar panels from Nawabshah (at best a small city) to sell in Karachi (Pakistan's commerical capital) ; (ii) and second, there was no documentary evidence available to show prima facie that such a transaction actually took place, which is all the more important considering the amount of value involved at the heart of the alleged crime. Pakistan has achieved a significant legal victory at the Permanent Court of Arbitration (PCA) in The Hague against Tuwairqi Steel and its investors. The dispute, initiated in 2018, centered on alleged breaches of the Organisation of Islamic Cooperation investment agreement by Pakistan. The claimants accused Pakistan of not fulfilling commitments related to natural gas supply for their Karachi facility. The tribunal dismissed all claims and ordered the claimants to compensate Pakistan with over 1.8 million euros in legal costs and fees. “The recent announcement of an agreement between the Nigerian Government and cement manufacturers in Nigeria to peg the price of a 50kg bag of cement at between N7000 and N8000[1] (the “Pricing Mandate”) raises some important questions of competition law because price fixing is generally prohibited by Nigeria’s competition law ( the “FCCP Act[2]”). Price fixing is considered to be an offence under the FCCP Act as well under the EFCC Act[3]. Under the FCCP Act, a company can be fined up to 10% of its turnover. Individuals can be fined up to N10,000,000 (Ten Million Naira). Mayor Karachi, Barrister Murtaza Wahab, mentioned that two water treatment plants are being set up in Manora, which will provide 500,000 gallons of water. He urged businessmen and the industrial community to collaborate with the government under public-private partnerships. There's a problem of water the_ft, with some businesses and citizens involved. Currently, there are seven hydrants functioning in the city, and water tankers are being registered. Around 3,000 tankers have been registered so far. In 2017-18, 34 licenses were issued for using underground water, but some were misused. The Mayor addressed industrialists and traders at the Federation of Pakistan Chambers of Commerce and Industry. He highlighted the reduction of municipal utility tax rates by KMC to 50 rupees, with a maximum of 200 rupees. However, there's an ongoing court injunction against including municipal tax in electricity bills for the past two years. Karachi requires 6,000 megawatts of electricity; there's potential for solar parks on 500 canals. Charting your land and registering with the cartographic unit of the Urban and Regional Planning is very important. It is important to note that land in Abuja can only be charted and registered once. As in the case of Abuja municipal area council (AMAC) land, notwitstanding your letter of Offer/Conveyance of provisional approval or AGIS regularization, leaving your land uncharted and unregistered gives room for land grabbers to effect change of ownership to your land and chart same in its new name. Charting also helps in reducing boundary disputes and also helps during boundary disputes litigation. It is part of regulatory compliance to chart your land and register same with the cartographic unit of URP in FCT to ensure you can use the land legally. It improves the marketability of your land.
