Today I was in court, and the judge was frustrated because she had an entire room of people without attorneys who didn’t know the complicated and nuanced procedures of immigration court. And this was just a basic scheduling hearing, let’s not even get to complicated final hearing where pro se respondents are expected to make complicated legal arguments they don’t know, utterly reliant on an (oftentimes unfriendly) judge and (oftentimes unqualified) interpreter. Universal representation doesn’t mean everyone will win their case. But it means people won’t lose their case because they lack the legal knowledge to represent themselves. I cannot reiterate how complicated immigration law, in particular asylum law, is. I’ve been practicing mostly asylum law for eight years and the law is constantly changing. It can be difficult for attorneys to keep up, much less persons who had to flee, lack resources, and do not speak English. Losing an immigration court case means deportation. That can be catastrophic and deadly. We should be creating a system of universal representation and due process. Additionally, this will help the inefficiencies that are rampant in immigration court. Judges who are frustrated at the pro se respondents who don’t properly file documents (a process not intuitive or easy, especially here in the NYC courts), who don’t understand the complicated legalese the judges speak in regardless of their audience will be able to move through hearings far quicker with attorneys.

.S. District Judge Roy Altman issued a court order that temporarily blocked a major portion of Florida's SB 1718, signed by Gov. Ron DeSantis, which would make it a felony to transport undocumented immigrants into the state. The controversial law, which went into effect on July 1, 2023, imposes restrictions and penalties aimed at deterring the employment of undocumented workers in the state and makes it a felony to “knowingly and intentionally” transport an undocumented immigrant to Florida. Judge Altman argued that Florida's law "extends beyond the state's authority to make arrests for violations of federal immigration law," likely making it invalid, Reuters reported. Immigrant rights activists and the Florida Farm Workers Association filed the lawsuit last July, specifically focusing on the transportation of people who entered the country illegally. To start deportation, the U.S. government must prove alienage in immigration court. They initially proved non-citizenship due to incomplete records. The judge then decides admissibility, with noncitizens bearing the burden of proof. For those admitted, the government must prove removability with solid evidence. Reasons vary, like unlawful presence or criminal convictions. If not removable, the case ends, possibly allowing future attempts at removal. Immigration Minister Andrew Giles has replaced "Direction 99" with "Direction 110" to better protect the community by deporting non-citizens with histories of family or sexual violence, even if they've lived in Australia for most of their lives. This change addresses concerns that the Administrative Appeals Tribunal (AAT) was misinterpreting Direction 99, allowing some people with criminal records to avoid deportation. Direction 99, introduced last year after New Zealand's lobbying, required decision-makers to consider a person's ties to Australia, community protection, family violence, children's best interests, and community expectations when reviewing visa cancellations. Direction 110 now emphasizes community safety as the highest priority, stating that tolerance for criminal conduct "may" be afforded and reducing emphasis on Australian connections.
