Analyzing from a #surety point of view, this particular post will touch on the GC perspective: - Prequalify your owners - Especially for private works, ensure that funds are held in escrow for your particular project, and in Utah, perfect your lien rights early. If the Owner refuses to escrow funds, ask for a financial statement from the owner, that should be prepared by a CPA, and ask your #insurance or #surety agent and your #surety underwriter to review the financial for any red flags they may see. - When a project is stalled, there are a number of impacts. Are you prepared for the interruption in cash flow? Are you ready for the lost profit from the current job and potential opportunity cost of not performing other work? Do you have a legal fund set aside for what will end up typically being a multi-month (more likely year) battle to pursue remedy against the owner and make you and your subcontractors whole? Are you ready for overhead to accrue as your PM, foreman, and superintendent are idle? Do you have other work to apply that project team to, or will you potentially lose them in a tight labor market? - Lastly, measure the impact of a stalled project on your subcontractor team. Subcontractors are partners in construction. A poorly prequalified owner relationship may impact your ability down the line to win future work with your quality subcontractor partners.
