Litigation Finance and Small Businesses. Opponents of litigation financing often argue that it empowers lawyers to go after small businesses that lack the resources to fight back. Many such opponents, of course, aren’t small businesses themselves; they’re large companies that typically enjoy litigation resources vastly superior to those of their opponents. Which may be why they forget that although small businesses do get sued, they can also be victims of commercial wrongs. When that happens, why shouldn’t they have the same access to top-flight lawyers, experts, and other litigation assets that big business has when it goes to court? This recent article on one small business's success in leveling the playing field – a story also to be featured on this Sunday’s upcoming CBS "60 Minutes" broadcast – shows that they don’t have to.

The new business court system is facing a shortage of transactional lawyers among applicants for the 10 trial judge positions. Despite attracting candidates with judicial, litigation, and state agency experience, transactional lawyers with expertise in shareholder disputes, securities claims, and governance issues are lacking. Byron Egan, who helped draft the legislation, emphasized the critical role of transactional lawyers in these courts with The Texas Lawbook. “If you’ve been doing transactions for a period of time, you’ve invariably come across controversies. You’ve been involved in litigation. You may not be a litigator but you’re going to understand what the litigation process is, you’re going to understand what the consequences of decisions are, the importance of making quick, informed, convincing judgment of these cases.” For more insights from Byron and details on the new courts: https://lnkd.in/d-P3Cft8 #businesscourt #businesslaw #Texaslaw #Texas #TheTexasLawbook

I came across an article from earlier this year from Reuters discussing third party litigation financing. As a starting point, estimates are that TPLF yields returns 30% or more…those returns are coming from settlements and/or verdicts that claimants are receiving. So in addition to paying attorneys a third of any recovery, some claimants are also paying big shares to these funders as well. Which can significantly drive up claim severity, which drives up costs for the entire business community…and ultimately for everyone as consumers of the business community’s products/services. And yet, litigation financing is virtually unregulated and, in the vast majority of cases, we aren’t even able to get disclosures that a third-party funder is involved. As state legislatures begin to start fall sessions, I’m hoping this will be an area where we see some much-needed reform. https://lnkd.in/emAaW4MC

Business Lawyer doing M&A, governance advice. Available as Independent Director, qualified as disabled person for EDI. On OBA Council, Speaker at Law Society & OBA CPD Programs, Buying or Selling a Business 2024.
In 1991, I co-sponsored, with the Region of Halton, a program on how to handle your corporate lawyer as a business client. A few attendees wanted me to advise on how to handle their litigation lawyer on lawsuits that were going on and on. Litigators know how to litigate. They make their living off litigation. They won't really pursue settlement until you say, "Uncle!" and stop paying their retainers. Commercial lawyers like to do deals, not fight over things. If you want to resolve a dispute, if you really want to do that, get a commercial lawyer to have a look at the file. #litigation #lawyers #corporatelawyer #commerciallawyer #business Virtually every lawsuit is about money, directly or indirectly. Sawing it in half is not always the best solution. Parties should decide on their sweet spot for settlement at the outset of the court proceedings, not three years and $50,000 later. Litigation is not the pursuit of truth or justice.

Duane Morris has added two attorneys to its Atlanta office, looking to continue building out its busy securities litigation practice. The two partners, Terry Weiss and Stefanie Wayco, arrive from national full-service firm Maynard Nexsen along with their three legal assistants after a short three-year stint at the firm. “The purpose of the Maynard relationship was really client driven,” Weiss said. “We had this one very large matter for a joint client and were trying to really find the right fit for us and them and to try to get that case resolved, which is exactly what we did.” . . . #employmentlaw #lawfirmgrowth #securitieslaw #lawstudents #lawschools #leadership #progress #realestateattorney #lawfirms #atlantalawyer #legalrecruiting #AtlantaLegalRecruiters #theRMNagency #legalrecruitingfirm #legalrecruiter #legalrecruiters #legalsearch #atlantalegalrecruiters #atlantalawfirms #biglaw #smalllawfirm #inhousecounsel #associate #partner
