Former MMLA Lawyer Sworn in as Associate Justice on Minnesota Supreme Court On July 25th, former legal aid attorney Sarah Hennesy took the oath of office as a Minnesota Supreme Court Justice. Following law school and a career start in the eastern U.S., Hennesy’s first job in Minnesota was with Mid-Minnesota Legal Aid (MMLA) in its St. Cloud office. Under the leadership of deputy director Ann Cofell, Hennesy was one of the first to counsel clients in the Stearns County Felony Domestic Violence Court. Later, she became Stearns County district judge. Hennesy was appointed by Governor Walz to succeed Justice G. Barry Anderson, and she has served on the bench since mid-May ahead of her official swearing-in ceremony with Chief Justice Natalie Hudson. In her remarks, Hennesy promised to continue to be a voice for greater Minnesota and trial judges. In acknowledging the limitations of the justice system, she noted in the Star Tribune, “The reality is, the legal system is an institution that is built on a foundation of inequality by people who were themselves biased. Repeating the words of Chief Justice Nathan Hecht, Justice of the Texas Supreme Court, who has been instrumental in the initiative to expand access to justice by opening new avenues for legal service delivery: “Justice for only those who can afford it is neither justice for all nor justice at all.” These newly introduced rules aim to provide low-income Texans with greater access to legal services across the following legal and judicial areas: Small civil matters in justice courts, uncontested divorces that do not involve children or complex property issues, certain uncontested family protection matters, limited estate planning and probate matters, and certain aspects of consumer debt cases. AI enhancements and other factors could extend this panoply of services to other consumer claims. Legal landscapes in different jurisdictions are expected to follow this trend of smart deregulation, especially in resource-consuming legal services with significant individual impacts. 🌟 Exploring Nonlawyer Providers to Enhance Access to Justice in DC 🌟 The DC Courts are considering proposals to allow trained nonlawyers to provide legal assistance for residents facing civil legal challenges, aligning with similar efforts in states. 🔍 Why This Matters: Access to Justice Gap: A staggering 75-97% of individuals in certain civil cases in DC do not have legal representation, often due to cost barriers and limited resources. Innovative Approaches: The DC Civil Legal Regulatory Reform Task Force is exploring proposals to use trained nonlawyers—like licensed paraprofessionals and community justice workers—to address urgent legal needs in housing, family law, and public benefits. Broader Landscape: Similar initiatives are underway in other states, including Texas, to enhance access to justice for underserved communities and improve overall court efficiency. 🗣️ Get Involved: The DC Task Force is seeking input through: Surveys: Online surveys for legal and social service professionals and community members are open until October 11. As a legal professional, conducting thorough research is paramount when handling a case before the Delaware Court of Chancery. In this article, I'll share my recent experience delving into the legal framework surrounding a civil complaint filed in this esteemed court of #Delaware. 1) Laying the Foundation: Delaware Code Title 10. The starting point of my research was Title 10 of the Delaware Code, which provides a comprehensive understanding of the structure and procedures of Delaware courts. This foundational knowledge laid the groundwork for navigating the intricacies of the legal system. 2) Exploring the Delaware General Corporation Law (DGCL). Next, I turned my attention to Title 8 of the Delaware Code, specifically the DGCL. As a blueprint for corporations incorporated in Delaware, this law offered invaluable insights into the rights and obligations of my client, potentially a corporation itself, in pursuing legal action. 3) Navigating the Court of Chancery's Resources. Delving deeper, I explored the wealth of resources available on the Delaware Court of Chancery's official website. This included the Operating Procedures, the Court's Rules, and the Best Practices for Electronic Filing (e-filing) or traditional filing with the Register in Chancery. These resources provided crucial details on the specific requirements for presenting a case before the Court. 4) Staying Informed with Administrative Directives. Finally, I reviewed the relevant Administrative Directives issued by the Chancellor of the Court. These directives offered additional guidance on specific filing procedures, ensuring my approach adhered to the latest court protocols. 5) Crafting a Well-Supported Civil Complaint By systematically examining these legal resources, I gained a comprehensive understanding of the legal landscape surrounding my client's case. This in-depth research will prove invaluable in crafting a well-supported and strategically sound civil complaint for the Delaware Court of Chancery. As a legal professional, I understand the importance of staying up-to-date with the evolving legal landscape.
