Specialist construction courts can teach us how to keep construction arbitrations efficient. They face many of the same challenges as international construction arbitration and can respond more firmly to them. The Hong Kong courts use several tailored approaches to deal with construction disputes: (1) Appointment of a single joint expert unless there are compelling reasons for party-appointed experts; (2) Early identification of expert disciplines and issues so that evidence is aligned to the issues in the case; (3) Standard timelines for submissions in interlocutory applications and a deadline to make interlocutory applications; (4) Early fixing of the pre-trial review and the hearing date and strong resistance to shifting the hearing date once it is fixed. All of these steps require the parties to consider clearly, and at an early stage, what is at stake in the proceedings. Introducing the Relational Construction Law Collaborative! The RCLC was born of a conversation some years ago about the perceived (and real) failures of contract law in meeting the demands of increasingly complex commercial relationships, of which the construction industry is an excellent case study. My collaborators and I have taken that informal conversation and decided to create, as a start, a webinar series where speakers will explore the legal possibilities for inserting the commercial relationship within the contractual one. In the inaugural webinar on 22 April, Severine Saintier, Dr Jessica Viven-Wilksch and David Christie will provide an overview of relational contracts in scholarship and legal decisions, and the importance of collaboration, cooperation, and good faith as applicable to construction contracts. The chapter, titled 'Employers' Claims and Remedies', examines construction disputes that proceed to arbitration and are initiated by contractors. It analyses the differences in positions between contractors and employers, and considers the range of claims that employers generally pursue in arbitration.
