As H.121 is being considered for signature, I think it's worth sharing the most powerful House Floor speech I've heard in my first term. The entire room stood still. House Commerce & Economic Development Chair, Michael Marcotte (R) is one of the most impressive leaders I've ever had the privilege of learning from. "I think we all need to realize what Private Right Action is and what it does... I think that the balance that we have struck in this amendment, by limiting the PRA to data brokers and large businesses that have over 100,000 Vermont consumers - try to imagine how many of our businesses have [that]... To me, that sounds like Big Business - Big Tech - hiding behind organizations that they fund, bringing that fear to states that want to protect their consumers... At a fundamental level, for us to limit the ability to use the courts for what our Constitution made our courts for, runs counter to what we ought to be standing for. And again, that's not a partisan position, that's what our Constitution says our courts are for... If we vote against this bill because there's a private right of action in this amendment, then we're telling our constituents that we're extinguishing your right to seek redress over grievances you might have with a business over your data and how they deal with it... We're extinguishing that right! Or we can go home and tell our constituents that we're here and we're protecting you! Every one of you! We can go home and tell our constituents that we protected you if we pass this bill. That is what we can do." Corporations are required to have bylaws. Bylaws and amendments will go into effect as soon as they’re passed, but corporations are still required to file a document detailing their changes. When required, corporations file a copy of their bylaw changes with the Secretary of State in the state where their corporation is registered. Information about filing changes is usually available on your Secretary of State’s website. Share your position Let the senator know your position on the issue you are calling about. You can say something like, Explain the impact Tell the senator what effect you think a particular bill, if it becomes law, will have on you, your children, business, or community. State Republicans in California have recently announced a series of bills aimed at supporting small businesses in the state. These bills were revealed during a press conference on the West Steps of the Capitol, where Republican lawmakers, small business owners, and advocates discussed the challenges faced by small businesses in California. The legislation focuses on addressing issues such as high taxes, burdensome regulations, rising costs, and retail theft. A broad group of business lobbying groups and chambers of commerce vehemently oppose a not-so-business-friendly new bill recently introduced by the California Senate (SB 1286) which would have a significant impact on commercial (business-to-business) debts and for companies utilizing personal guarantees. This proposed legislation could impact a business' ability to send late payment notices or disclosing payment history and could also affect the collection of finance charges under SB 478.
