Hello #connections, The recent incident involving the suicide of a female employee, hired by Quess Corp and posted at Axis Bank's branch in Noida, brings to light a critical question on employer accountability: Who is responsible for third-party employees – the ones who hire them or where they are posted? Under the Contract Labor (Regulation and Abolition) Act, 1970 (CLRA), contract workers are primarily the employees of the contractor agency, with the contractor bearing direct supervision and control responsibilities. While the contractor holds the primary duty, the principal employer is vicariously liable for non-compliances, such as ensuring a safe work environment. However, the CLRA does not explicitly address the vicarious liability of the principal employer concerning mental health issues and workplace stress if the contractor fails to address them. Companies need to clearly outline roles and liabilities in service agreements when engaging and managing third-party employees. Founder and CEO of ElementSkill, Reetu Raina, emphasizes the shared responsibility of both parties in ensuring a safe and supportive work environment for employees, irrespective of their payroll arrangement. Raina highlights the importance of monitoring employee well-being by the payroll company and ensuring effective management by the company where the employees work.
