#SunPower Corp shares slid 35% to $3.93 in early-afternoon trading on Monday after the rooftop solar company revealed in a regulatory filing that lenders may demand immediate debt payment of $65.3 million after SunPower failed to file its third-quarter financial results on time.  The company noted it is currently in talks with the lenders for a waiver but warned it would not have sufficient funds to maintain its day-to-day operations should an agreement not be reached.  SunPower is majority owned by French energy giant #TotalEnergies SE (NYSE:TOT, EPA:TTE).   The higher interest rate environment has hurt home solar companies as rising borrowing costs have made it more expensive for customers to pay for solar panels, according to Bloomberg.   More at #Proactive #ProactiveInvestors #NASDAQ #SPWR http://ow.ly/ef4m10563LF

In June 2023 Energy Networks Australia (ENA) submitted a request to the Australian Energy Market Commission (AEMC) to change the National Electricity Rules in a way that would ensure the financeability of major new electricity transmission projects. The projects in question were identified in Australian Energy Market Operator (AEMO)’s Integrated System Plan (ISP) as necessary to support Australia’s energy transition by connecting new sources of renewable generation. ENA’s request identified that the existing regulatory arrangements for electricity transmission networks do not provide investors with enough certainty that the regulated cash flows available to those businesses would be sufficient to ensure the financeability of actionable ISP projects. Under the current regulatory arrangements, investment in these major ISP projects could result in the proponents losing their investment grade credit rating such that they are not ‘financeable.’ ENA sought to address this investor uncertainty problem directly by proposing the inclusion of a mandatory formula in the Rules that would guarantee that transmission networks would receive annual cash flows that are just sufficient to ensure that each project is financeable. The proponent business would not receive any additional cash flows – but the timing of the cash flows would change to ensure the project was able to maintain the necessary investment grade rating without injecting additional equity or seeking taxpayer support. The AEMC published its final decision on the matter in April 2024. It agreed that actionable ISP projects could face financeability problems. However, the AEMC’s Rule change failed to address the central problem that ENA had identified—namely the lack of certainty to investors that regulated cash flows would be set at a level that would make each project financeable. Under the new Rule, investors would not know whether the projects would be financeable until after they had committed to the project. Well, investors have now delivered their verdict on the AEMC’s Rule change. Two major super funds—Cbus Super Fund and Aware Super—that had invested equity in Transgrid and ElectraNet Pty Ltd have announced their intention to sell down their stakes in these businesses, citing the low cash returns they would face if they were required to finance further ISP projects in the current environment. Evidently, these two major investors do not think the AEMC’s Rule change properly addresses the potential financeability problems that may arise with new ISP projects, and have decided to vote with their feet.
