New legislation to cost 25,000 UK hospitality businesses over £60,000 a year! 🚨 Our brand new report: ‘Tipping Point: How new legislation will impact hospitality’, has revealed that the government’s Employment (Allocation of Tips) Act 2023 will push hospitality operators to breaking point, with 83% of respondents expecting to incur costs of at least £12,000 a year to comply - the equivalent of 118,690 operators across the UK. Key findings: 1️⃣ Two thirds (63%) of businesses currently take a percentage of tips from employees 2️⃣ Just 28% of hospitality companies are currently compliant with the new Act 3️⃣ Despite the new Act coming into effect later this year, less than half (42%) of hospitality workers have been told about their employer’s tipping procedures 4️⃣ Nearly half (44%) of operators and 59% of hospitality workers would consider the introduction of a Tipping Standard Practice, an official tip amount implemented ‘across the board’ for customers and a standard process for businesses to distribute tips to staff. In the past, service charges often disappeared into a murky system, leaving both customers and staff uncertain about where their contributions were going. But fear not; clarity is on the way! 𝐖𝐡𝐚𝐭'𝐬 𝐂𝐡𝐚𝐧𝐠𝐢𝐧𝐠? New legislation mandates that 100% of service charges must be distributed fairly, transparently, and consistently to staff. Yes, you read that right—no more deductions for breakages or other operational costs! This is a significant shift towards fair compensation for hardworking hospitality employees, including agency workers. 𝐓𝐡𝐞 𝐃𝐞𝐭𝐚𝐢𝐥𝐬 𝐌𝐚𝐭𝐭𝐞𝐫 As they say, the devil is in the details. While the law is clear in principle, nuances like the treatment of 'tronc' provisions require careful consideration. HMG plans to consult stakeholders to ensure all aspects are addressed thoroughly. Expect a statutory Code of Practice to clarify further in the coming months. 𝐖𝐡𝐚𝐭 𝐁𝐮𝐬𝐢𝐧𝐞𝐬𝐬𝐞𝐬 𝐍𝐞𝐞𝐝 𝐭𝐨 𝐊𝐧𝐨𝐰 Get ready to update your policies! Businesses will soon be required to prominently display their tip and service charge policies for staff and customers. Additionally, individual staff members must be accounted for personally, with strict deadlines and penalties for non-compliance. The new tips rules have been put back to 1 October 2024... this provides more time for the hospitality sector to be prepared - there are a number of issues for operators to consider. This is a link for further support guidance with this.

Only 28% of hospitality businesses are compliant with the Employment (Allocation of Tips) Act coming into effect this October! ⏰ This new legislation is designed to ensure that employees receive 100% of their tips left by customers. Research by the hospitality tech specialist 'Three Rocks' suggests that less than a third of hospitality businesses are currently prepared. This means many are at risk of legal repercussions if they don't ensure fair and transparent tip distribution and continue taking a percentage of staff tips, a practice that will be illegal under the new law. Although the legislation is introduced with good intentions, the transition isn't without challenges. Compliance costs can be significant, with 83% of businesses expecting to incur costs of at least £12,000 annually, with some reaching up to £360,000. Research also shows that nearly half of hospitality workers have never been informed about how tips are distributed amongst staff, and many feel they should receive more tips. What is a TRONC? 🤔 We work with lots of businesses across the industry and you'd be surprised by the amount of people who have never heard of a TRONC So what is a TRONC and how does it impact you... A TRONC is a special pay arrangement used to distribute tips, gratuities and service charges. A TRONC system is set up to ensure all staff members, including those who may not typically receive tips (such as back-of-house, and non-customer-facing members), get their fair share. TRONC systems are common in a wide range of hospitality businesses such as restaurants, bars, hotels, cafés and more. The agreement also introduces advantageous benefits such as National Insurance exemptions for the business, and the team. With the new legislation coming into effect very soon, it is important to be aware of changes around tipping, especially if you already operate a TRONC. Here are some key changes: 🔔 100% of tips are to be distributed no later than a month after they have been received, this means no admin costs are to be deducted from the TRONC pot. 🔔 Employers must have a tipping code of practice/policy and this must be available to all employees, including agency staff. 🔔 A business must keep a record of tips received and distributed for three years. 🔔 Employees are entitled to request to see how the business receives tips and their allocation but not their peers.
