Matt and Dinyse are a young couple living with their pets in Beaudesert, Queensland. Before their accident, they loved rock climbing, hiking, and travelling throughout Australia. Matt and Dinyse both worked physical jobs that they loved. Matt was a mechanic by trade, and Dinyse worked in a warehouse and as a horse trainer. They were SES volunteers in their local community. Toxic workplaces and bad managers might be tempted to penalise their employees for exercising their workplace rights. What kind of rights are we talking about? It might be something as simple as exercising a leave entitlement, or it might be something like exercising your right to make a complaint, get information about your employment, or act as a whistleblower. If you lose your job, and it wasn't fair, that means you have a case for unfair dismissal - right? Maybe. But sometimes, that's not the best option to pursue. In Australian workplace law, there are other ways to be compensated when you've lost your job because the employer did something wrong. Discrimination or retaliation are just a couple of examples of employers' behaviour that can give rise to what's known as a general protections claim. And for many plaintiffs, pursuing this kind of claim is the better option. On Saturday just gone, in Rockhampton, Emily Mawson, a lawyer in my Maurice Blackburn Lawyers Dust Diseases team in Queensland, was announced as the Federal Australian Labor Party candidate for the electorate of Capricornia. I don’t know politics like some, but I do know Emily. And what I know of Emily is that, if elected, she will be an outstanding advocate for her community and constituency. Why do I know this? Well, there are a few reasons. Apart from being an excellent Dust Diseases lawyer who has worked closely with me for the past 2 years on a large breadth of litigated matters across the country on behalf of the most deserving clients, Emily grew up in Emerald, Tieri and Moranbah in Central Queensland. She is the eldest daughter of David, a coal miner, and Tracey, who works in skills development for the mining industry. She understands and is part of the community she is seeking to represent. And now she is returning to her community to help and to serve them. This is to be treasured. Emily also has whip sharp intellect which is matched only by her heart and her desire to do good in this world. I know this because I’ve seen it action and I’ve seen firsthand how she has harnessed these gifts for good. And it is a very special thing to witness. No matter what side of politics you identify with, our elected members need to have at least some of the qualities that Emily possesses. As a legal community, we should embrace difference of opinion but always support the best of us who are brave enough and selfless enough to put up their hand up for public life because the scrutiny and the judgment of strangers which follows is a brutal game.
