This year’s theme calls for action that can unlock equal rights, power and opportunities for all and a feminist future where no one is left behind. Central to this vision is empowering the next generation—youth, particularly young women and adolescent girls—as catalysts for lasting change. The Full Court of the Federal Court of Australia has handed down a significant decision on prior circumstances exclusions in claims-made policies. In Allianz v Uniting Church [2025] FCAFC 8, the Court ruled that exclusions based on the insured’s prior knowledge may be void under section 52 of the Insurance Contracts Act. This decision has important implications for how insurers approach non-disclosure and misrepresentation defenses in financial lines insurance. In a recent case, the Court of Appeal clarified the scope of access to the benefit of the uninsured liability scheme. The court ruled that access to the scheme is restricted to claims involving "injuries" as defined under the 1987 Act, excluding dust diseases like silicosis. This decision offers important clarity for litigants in dust disease cases, particularly where employers are uninsured, by confirming that the uninsured liability scheme is not liable to cover claims for common law damages related to dust diseases.
