    Apple must ensure its operating system iPadOS complies with the Digital Markets Act obligations 👇 For example, Apple must  🔦 Allow users to set the default web browser of their choice; 📱 Allow alternative app stores; 🎧 Provide access to accessory like headphones and smart pens. 📃 Apple also published a compliance report detailing the measures it has taken for iPadOS to comply with the DMA.     🔴 The European Commission fines Teva €462.6 million over misuse of the patent system and disparagement to delay rival multiple sclerosis medicine 👇 ⛔ The Commission found that Teva abused its dominant position to delay competition to its blockbuster medicine for treating multiple sclerosis, Copaxone. This was done by artificially extending Copaxone's patent protection and systematically spreading misleading information about a competing product to hinder its market entry and uptake. 🔍 Our investigation found that Teva abused its dominant position in the markets for glatiramer acetate in Belgium, Czechia, Germany, Italy, the Netherlands, Poland and Spain. ❌ Today's decision concludes that Teva's abuses were complementary and together amounted to a single and continuous infringement of EU law. 💉 This is the first time the Commission has imposed a fine in relation to these two types of practices.     🔴 Today the EU and UK conclude technical negotiations for a future competition cooperation agreement ⬇ 🤝 The future competition cooperation agreement will allow the Commission, the EU Member States' competition authorities (NCAs) and the UK Competition and Markets Authority to cooperate directly in competition investigations 🕵♀️ It is the first EU competition cooperation agreement to enable NCAs to cooperate directly with a third-country competition authority. ℹ The cooperation agreement will set out that important antitrust and merger investigations are brought to each other's attention. 📌 It will also allow the coordination of investigations between the jurisdictions involved when necessary and set out clear principles of cooperation aimed at avoiding any conflicts between jurisdictions. ⏳ The agreement will enter into force after both the EU and the UK have finalised their ratification procedures. ✍ The Commission will draft proposals for Council's decisions to sign and finalise the agreement, pending consent from the European Parliament.     🗨 "In today’s fast-evolving markets, we must adapt our approach to ensure that mergers with significant competitive impact are reviewed efficiently, even if they fall below traditional thresholds" 🗣 DG Competition Director General Olivier Guersent at the Academy of European Law ERA’s Annual Conference on European Competition Law that took place this week in Trier. Here below some of the key messages of his keynote speech ⬇ 🎯 After 20 years, Regulation 1/2003 remains a success, but we must continue improving, especially in streamlining investigations and enhancing cooperation among competition authorities. ⚖ As markets become more complex, our Article 102 Guidelines will ensure robust antitrust enforcement, grounded in economic principles and committed to protecting consumers. 💼 With 19 cartel decisions and €2.3 billion in fines over the last five years, we are sending a strong message of deterrence across different sectors. 👂 Our leniency programme’s resurgence reflects our ongoing efforts to uphold the integrity of competition enforcement. #EUCompetition

    🔴 The European Commission has approved a €724 million Danish scheme to lower the rate of a new greenhouse gas emissions tax for certain companies 👇 🎯 The measure aims to prevent the risk of carbon leakage, when companies relocate production outside of the EU to countries with less ambitious climate policies, increasing greenhouse gas emissions globally. 🔍 The Commission assessed the scheme under EU State aid rules as well as under the 2022 Guidelines on State aid for climate, environmental protection and energy, which allow Member States to grant aid in the form of reductions in environmental taxes and parafiscal levies. In particular, the Commission found that ⬇ ✔ The measure contributes to the development of certain economic activities; ✔ The scheme is necessary and appropriate to support only those companies incurring a significant increase in production costs due to the CO2 emissions tax; ✔ The scheme is proportionate as each company benefitting from the measure will still pay 33% of the standard tax rate and any negative effect on competition and trade in the EU will be limited in view of the design of the measure.     🔴 The European Commission fines České dráhy and Österreichische Bundesbahnen €48.7 million over collusion to exclude common competitor 👇 ⛔ ČD and ÖBB colluded to prevent a new entrant, RegioJet, from accessing used wagons, thus restricting competition in the rail passenger transport market. 🔍 The Commission's investigation found that, between 2012 and 2016, ČD and ÖBB colluded to maintain their market position and impede RegioJet's expansion in Czechia and on the international rail route between Prague and Vienna, in breach of EU Competition rules. In particular, the Commission found that ČD and ÖBB: 📌 Collusively timed wagon sales so that RegioJet could not buy ÖBB's used wagons; 📌 Rigged ÖBB's used wagon sales procedures so that ČD could buy the wagons instead of RegioJet; 📌 Agreed on a suitable buyer other than RegioJet for ÖBB's used wagons that ČD was not interested in; 📌 Exchanged confidential information about the bids and degree of interest of other bidders participating in the sales. In setting the level of fines, the Commission took into account various elements, including the serious nature of the infringement, its geographic scope and its duration.     🔴 The European Commission approved the proposed acquisition of Groupe Courir SAS by JD Sports 👇 The approval is conditional upon full compliance with the commitments offered by the parties. 🔍 The Commission's investigation showed that the transaction as initially notified would have reduced competition in the retail markets for: 📍 Leisure and performance sports footwear and apparel in Portugal; 📍 Leisure sports footwear in certain local markets in France. ⛔ The Commission found that the merger would have led to high market shares and increased concentration in several local markets. It also concluded that there wouldn't be enough competitors left to effectively challenge the merged company, which could result in higher prices and fewer options for consumers. ⚖ To address the Commission's competition concerns, the parties offered to divest all Courir stores in Portugal and several stores in certain areas of France to Snipes, a direct competitor focusing on the retail supply of leisure sports goods. ✅ These commitments fully address the competition concerns identified by the Commission by ensuring sufficient competition and choice in the affected markets.
