EU to consider EU-UK youth mobility scheme On 18 April 2024, the European Commission adopted a Recommendation for a Council Decision authorising the opening of negotiations for an agreement between the EU and the United Kingdom on youth mobility. The initiative aims to facilitate youth exchanges, making it easier for young EU citizens to travel, work and live in the UK, with reciprocity for young UK nationals in an EU member state. The envisaged agreement on youth mobility should be guided by the following parameters: Limited to young Union citizens and United Kingdom nationals aged 18-30. The period of stay is limited to a reasonable timeframe (e.g. 4 years) for different purposes: to work, study, train training (including internships), research, volunteer, other activities or just visiting/travelling during the period of stay; Not be subject to a quota; The treatment of beneficiaries be equal to nationals, at least in respect of working conditions, including pay and dismissal as well as health and safety at the workplace, freedom of association, certain aspects of education and vocational training, tax benefits, in so far as the person is a tax resident, and advice services afforded by employment offices; Equal treatment be provided in respect of tuition fees for higher education – which his interpreted as meaning that participants in the scheme would pay home student fees, and not international students; That the United Kingdom “healthcare surcharge” is waived for Union beneficiaries; Conditions for the exercise of the right to family reunification with the beneficiaries. The explanatory memorandum notes state that: in the course of 2023, the United Kingdom approached several (but not all) Member States with the intention of negotiating arrangements on youth mobility, modelled upon the United Kingdom’s youth mobility visa scheme. This approach has created a concern that it would result in differential treatment of Union nationals. It is proposed that an agreement between the Union and the United Kingdom on youth mobility would seek to address some of the main barriers to mobility for young persons posed by current rules applied in the Union and in the United Kingdom. It would be reciprocal, i.e. all Union citizens and all United Kingdom nationals would benefit from it. The Commission's Recommendation will now be discussed in the Council of the EU. If adopted, the Commission would be empowered to launch negotiations with the UK on youth mobility. The Commission also suggests that this discussion could be usefully supported by a parallel discussion on the possible association of the UK to Erasmus+. Whilst the proposal has been rejected by the UK Prime Minister, it sets out a potential building blocks for a further discussion, by the current, or future UK Government.

Welcome to the Winter Edition of the Employment and Business Immigration Law Newsletter. Please follow the link below for a summary of the key cases an update on the Employment Tribunal rules. This edition is edited by Helen Murphie, Partner in the Employment Team and Head of the Immigration Team. We would first like to congratulate Sara Kennedy who has been promoted to Partner in the Employment Team. Sara, who is a key member of the Danish desk at ebl miller rosenfalck, is a hugely knowledgeable and experienced employment law solicitor. She has been providing legal advice to Nordic, international and UK employers and senior executive employees for more than 16 years. Our employment team has been busy cementing its international ties over recent months. We have received a number of new instructions from German, US and French companies, and European and international individuals planning to live and work in the UK. Edzard Clifton-Dey Clifton Dey, Partner in the Employment team, and myself recently returned from visiting our ebl partner companies in Germany: Frankfurt, Dusseldorf and Wuppertal, where we also met clients. Philip Henson, head of the Employment team, has also recently visited Dallas, US, on business. Earlier in the year, our partners attended an AI and Legal Practice seminar in Cyprus and our firm also visited Brussels for the annual ebl conference with counterpart lawyers from France, Germany and Belgium. Philip Henson has been working tirelessly as ever behind the scenes in the legal arena. In October 2023, he was appointed as the President of the Westminster and Holborn Law Society. With his President’s hat on, he recently attended the ‘Rentrée du Barreau de Paris’, the Opening of the Legal Year of the Paris Bar. The society is twinned with the Paris Bar which represents some 30,000 French lawyers. We have exciting news for the 2024 as we will be welcoming a new member to our team. Update: The Economic Crime and Corporate Transparency Act As you may be aware, the UK Government has taken steps through the Economic Crime and Corporate Transparency (ECCT) Act to tackle economic crime and improve transparency relating to corporate entities. The ECCT Bill achieved royal assent on 26 October 2023 and has now become an Act of Parliament. In summary, the Economic Crime and Corporate Transparency Act (the “Act”) has introduced reforms that include: · Introducing identity verification measures for all new and existing registered directors and people with significant control; and · Broadening the Registrar of Companies House’s powers to become a more proactive gatekeeper over company data filed. Additionally, the Act mandates that every company in the UK must have a registered email address that is deemed appropriate. Once the relevant provisions of the Act come into force, the registered email address will be requested in connection with the incorporation process, and for existing companies, on filing the first confirmation statement. Changes It is expected that the first set of measures introduced by the Act will come into force in early 2024 and will affect the company formation process as follows: · A registered email address having to be provided for the proposed company during the incorporation process. · Companies not being able to use a PO Box as their registered office address. · New statements in the incorporation process to confirm that the company is being formed for a lawful purpose, that the registered office address is an ‘appropriate address’, and that the registered email address is ‘an appropriate email address. · New powers for the Registrar of Companies to question information which companies submit and to reject information which is incorrect or misleading.
