Andrew Jones, Principal Planner, has secured permission on appeal for the erection of two self-build plots near Lower Halstow in Swale district in Kent. The scheme constitutes a further phase of the previously approved scheme for nine custom build homes on a former equestrian site, for which Andrew also helped secure approval of Reserved Matters. The Inspector found that the benefits of the delivery of two plots for self-build, in the context of a 5-year housing land supply shortfall and a shortfall against the Council’s statutory duty to meet the needs of those on its self-build register, attracted sufficient weight to overcome the identified policy conflicts. This successful appeal decision by Tetlow King Planning highlights the importance of Councils being proactive in meeting the needs of those on their self-build register and the seriousness with which Inspectors are now treating statutory duty failure in decision taking. For prospective self-builders and developers, it further underlines the potential that exists on appropriate sites in authority’s where the Council cannot demonstrate that it is meeting its statutory duty with respect to the delivery of serviced plots for self-build and custom housebuilding. The benefits arising from proposals for self and custom build on sites which may be considered contrary to policy – for example by virtue of being outside an identified settlement boundary – and the weight ascribed to addressing such unmet housing needs in the planning balance can be sufficient to outweigh the harms alleged. This represents yet another appeal decision where Tetlow King’s self and custom build expert evidence has assisted in demonstrating that the benefits arising from such housing can outweigh policy conflicts. The proposed dwellings will offer two self-builders an opportunity to be part of a charming wider scheme set in attractive Kent countryside.
