After five years of negotiation and planning, the Berkeley City Council has tightened the rules for anyone who tears down residential buildings, requiring that all rental units, affordable and otherwise, be replaced with at least the same number of dwellings when a new structure is erected. Changes to the city’s demolition ordinance, approved last week, are meant to bring the city into compliance with a state law aimed at forcing cities to preserve housing stock, while also encouraging new development. Thanks to Don Pitman for peaking my interest in something new. Did you know that the 1926.850(a) OSHA standard accounts for up to three-fourths of the citations on a demolition worksite? In particular, 1926.850(a)(1) which requires an "engineered survey" to be completed prior to starting demolition. Fines typically range from $1,000 to $15,625 per violation but can be as high as over $150,000 for repeat violations, while a survey could range anywhere from $1,000 to over $100,000 based on the project's complexity.
