Could European Human Rights Law help deliver Europe’s EU climate targets ? ——————————————————— This landmark lawsuit has shown that local objectors and “petrified planners” can’t hold back sensible projects to protect the environment. The Judge Criticizes the Irish planners - An Bord Pleanála over its Renewable Energy Inaction, that resulted in Ireland losing out to the AI infrastructure boom now taking place as well as missing climate targets. A recent High Court judgment by Justice Richard Humphreys has sent shockwaves through Ireland’s planning and renewable energy sectors. The judge accused An Bord Pleanála (ABP) of being “petrified” to approve renewable energy projects, even when compliance with EU climate laws demands action. The case focused on a 13-turbine wind farm in Co. Laois, proposed by Coolglass Windfarm, a subsidiary of Statkraft. The board’s decision to reject the project was overturned, with Humphreys stating ABP failed to fulfill its legal obligations under the 2015 Planning Act and the European Convention on Human Rights Act of 2003. Quoting Otto von Bismarck, Justice Humphreys remarked, “When a man says he approves of something in principle, it means he hasn’t the slightest intention of putting it into practice.” His ruling underscored the urgent need for reform, calling for better training in climate law and science for ABP members. 🚨 Key Points: • Justice Humphreys criticized ABP’s reluctance to approve renewable energy projects, citing a “business as usual” approach that undermines climate goals. • The court ruled in favor of Coolglass Windfarm, deeming ABP’s refusal a breach of legal duties. • Wind Energy Ireland emphasized the ruling as a legal mandate to prioritize climate action in planning decisions. The judgment serves as a wake-up call for Ireland’s planning authorities to align with climate objectives. Justice Humphreys warned that failure to act on the climate emergency could lead to far worse, chaotic outcomes for landscapes and ecosystems. Great to see common sense entering the stage where local objectors hold back progress in the wider community interest and planners just don’t understand the laws or consequences of their actions. #ClimateAction #RenewableEnergy #PlanningReform
