🏠 The recent County Court decision in Kwik-Fit Properties Ltd v Resham Ltd [2024] EWCC 4 is a notable business lease renewal claim pursuant to Part II of the Landlord and Tenant Act 1954 in which the tenant sought to negotiate the inclusion of a tenant-only break clause on renewal where none was included in the original lease.

Sadly landlords/property owners are receiving market rate rents for properties that are often below market rate condition. The only person from the housing authority to see the properties is the HCV Inspector. HUD nor the Housing Authority have a question on the inspection checklist to record the overall condition of the property. Properties are often receiving excess rents over their market value as the only tool the Housing authority staff utilize to decide rent values are based on zip code.

Have you heard about the newest Housing Quality inspection process National Standards for the Physical Inspection of Real Estate: Inspection Standards (NSPIRE) created by HUD?
NSPIRE should new Public Housing Authorities across the US estimate a potential NSPIRE score based on the types and locations of deficiencies identified during an NSPIRE inspection. HUD’s Real Estate Assessment Center (REAC) assists in improving housing quality by performing accurate, credible, and reliable assessments of HUD’s real estate portfolio. REAC’s primary mission is to provide our customers with independent, actionable assessments that advance risk-informed decisions about the condition of the nation’s affordable housing portfolio.
The new NSPIRE model prioritizes health, safety, and functional defects over appearance. It implements inspections that better reflect the true physical conditions of the property. The NSPIRE model supports the adoption of sound, year-round maintenance practices.
IEI's team of housing inspectors are already certified in NSPIRE inspection protocols and looking at advanced internal training to standardise the inspection results and elminate bias where possible.

Thames Valley Chamber of Commerce CEO Paul Britton joined a major policy announcement at the iconic Pinewood Group Limited earlier this morning, where the Prime Minster delivered his 'Plan for Change' speech.
Paul said: "The announcement of 150 infrastructure projects stood out, and we will be lobbying to make the case for Western Rail Access to Heathrow and other digital, road and rail improvements. Hitting these milestones is going to require outstanding execution to make change happen and this is where it has faltered in the past."

Our project pipeline is full (see my previous post below) 📈, yet we’re still being asked to take on more work 🙄
We’ve clarified that we can only start in February 2025, but prospective clients are pushing for January or even sooner ⏳.
We would love a new challenge, sure! But as a small practice we are serious about our commitment to quality work.
Here’s the reality:
👉 Insisting on February might mean losing their interest come Jan 🚪. They lose steam (and appoint that friend's cousin who knows AutoCAD 🤦♂️)
👉Bringing in external consultants could allow us to deliver now 👷♂️🤝
👉Refusing the project ensures we stay focused on quality and capacity 🎯.
These are decisions every growing practice faces.
For us, the priority is maintaining standards while managing growth.
