The government, militias, and armed groups have committed widespread abuses with impunity, violating human rights and humanitarian law. The lack of transparency and independent oversight in addressing past and ongoing atrocities has only exacerbated the problem. Today, the #CJEU has delivered 3 landmark judgments with important consequences for EU asylum policies: 1) Women and girls in Afghanistan are at risk of gender-based persecution and must be protected: https://lnkd.in/euGGQUeS. In its reasoning, the Court made direct reference to #UNHCR's observations on this case: https://lnkd.in/em4vKjxW. 2) National authorities cannot designate countries of origin as safe only for some parts of the territory: https://lnkd.in/e6t9Kt6a. 3) Third countries that do not readmit asylum-seekers on their territory can be designated as safe. #Libya: New UN report points to the renewed violence and repeated violations that have resulted from the failure to deliver justice in Turhana, which itself emphasises the importance of accountability in Libya. “Years have passed since these terrible violations were committed [in Turhana], but the perpetrators have still not been brought to justice, nor have truth, justice or reparations been delivered to victims and their families,” said UN High Commissioner for Human Rights Volker Türk. “The impunity must end – there must be accountability in accordance with international due process and fair trial standards.” https://lnkd.in/emPVxD2N #torture #enforceddisappearance
