A new post from ibeckermannotrobot.blog. https://lnkd.in/ezS_GeAt The NPS has put out a revision to Bulletin 38 for comment. This draft greatly expands the guidance offered to nominating historic places that are important to traditional communities, but it is hampered by limits imposed by existing legislation and regulation.  Nominated places must still fulfill all current existing standards for significance and integrity. The authors have also exposed a problem with the entire construct of a traditional cultural place.  The guidance fails to show how it should stand separate from other historic places, resulting in a false dichotomy. The immediate answer is to update 36CFR60 to be more in tune with the intent and ever evolving understanding of the National Historic Preservation Act.

Indigenous Knowledge Exemption Proposal: Last month, I visited Hawaii to speak with Native Hawaiian leaders and visit sites (on Oahu and Maui) of cultural and religious significance to Native Hawaiians. Those conversations demonstrated the potential - actually, the need - for the ACHP to expeditiously implement our recently-adopted Policy Statement on Indigenous Knowledge and Historic Preservation by addressing challenges sometimes experienced during the ACHP's regulatory process (known as "Section 106"). After consultation with ACHP members and Hawaiian leaders, I have proposed an Exemption to Section 106 for Indigenous Knowledge-Informed Activities by Native Hawaiian Organizations (NHOs). ACHP has only issued an Exemption four times in its history - and this one charts new ground by exempting cultural preservation activities, as opposed to objects/methods (like electric vehicle charging stations, also recently exempted). That's why we need your feedback on the draft linked below. Though I've heard some say that they've been waiting decades (!!) for the federal government to do something like this, I feel strongly that time is of the essence. Look beyond current standards for identification of cultural resources for the purposes of compliance with Section 106 of the National Historic Preservation Act and determination of historic properties. Examine how the methodology may be enhanced to produce a better analysis, both in the field and on paper. Understand ways to expand documentation efforts to include a greater variety of input, perspectives, and interpretation.
