Australian victims lost almost $3 billion to scams last year alone. It's become a pressing issue, with scammers increasingly exploiting social media platforms in creative ways to cause significant financial harm to even the most tech-savvy of us. Marking Scam Awareness Week, our Commercial Litigation Partner Matthew Spain wrote an opinion piece for The Age discussing the question: who should bear the cost for the loss? "There is no one-size-fits-all solution to the problem, but the status quo is not sustainable. The issue of who should bear the responsibility for scam losses requires a balanced approach. A clear framework is needed, one that supports scam victims while ensuring that banks and digital platforms are not unfairly burdened if they have taken all reasonable steps to prevent scams and retrieve losses." As of today, the right to disconnect comes into effect. The right initially applies for employees working for medium and large businesses, with small businesses exempt from the new law until 26 August 2025.
