FLEXIBLE WORK | The recent decision in Kent Aoyama v FLSA Holdings Pty Ltd [2025] FWC 524 highlights the importance of how employers respond to requests for flexible work arrangements under the Fair Work Act 2009 (Cth). The Fair Work Commission’s ruling underscores that employers must provide well-reasoned, specific responses when refusing such requests. The case also emphasises the need for transparent communication and proper documentation, write Aras Mollison and Christian Mooney. ECONOMIC BRIEFING | NAB's Chief Economist Alan Oster has told an audience of Lander & Rogers' people, clients and colleagues that he is optimistic about Australia's economic outlook in the medium term, although financial stress persists in certain areas and geopolitical risk poses uncertainty for the global markets. Oster, who will shortly retire from his role as NAB's Chief Economist after 32 years in the role, joined Lander & Rogers this week in Melbourne for a special breakfast briefing presented to more than 300 guests, in which he shared key insights on the global and local economy - including trends in global growth in 2024 and the outlook for the year ahead; green shoots in Australia's economy; and his predictions for inflation, interest rates and the labour market in 2025. Following his briefing, Oster was joined by Lander & Rogers partner Peter Kritikides and panellists, Lendlease chairman John Gillam and Bunnings Chief Customer Officer Rachael McVitty, for a discussion of the risks and opportunities for business in the current economic climate. Panellists provided insights into their businesses and sectors, with both agreeing that pending interest rate cuts will provide some relief and boost consumer confidence, but that the potential impact of geopolitical risks remained front of mind for business leaders. SPORTS NEWS | The last few months have seen a number of interesting developments and case outcomes with implications for the sport and leisure industry. These include: - a renewed funding agreement between the World Anti-Doping Agency and Sport Integrity Australia - a recent Victorian Court of Appeal judgment which reaffirms that the duty of care owed by a sporting organisation is broad and requires it to take reasonable steps to protect young spectators from sexual abuse by volunteers - the resolution of tennis star Jannik Sinner's long-running doping matter. Sporting organisations are also reminded of the upcoming 1 November 2025 deadline to review their fixed term contracts, following recent changes to the Fair Work Act. Reflecting on an incredible Women in Leadership Summit! The Hatchery (Hub)’s Public Sector Women in Leadership Summit 2025 was an inspiring and thought-provoking event, and Lander & Rogers was proud to be a sponsor. Over two days, our team met with public sector leaders, who had come together to share insights, drive change, and champion the advancement of women in the public sector. A key highlight for us was hearing from trailblazing speakers - including The Rt Hon Dame Jacinda Ardern and The Hon Julie Bishop - on the power of leadership, resilience, and advocacy. Trailblazing is not just about breaking barriers or achieving milestones - it’s about creating space for others to thrive. It’s about mentorship, collaboration, and championing diverse perspectives to drive collective progress. We were especially honoured that our own Sally Moten closed Day 1 with a powerful speech, reinforcing our commitment to supporting and empowering women in leadership. So, what can we take away? That change is happening - but there’s more to do. From embracing neuro-inclusive leadership to strengthening pathways for women in government, this summit reminded us that real progress comes from collective action. At Lander & Rogers, we’re committed to turning these conversations into meaningful impact for our clients and communities. Let’s keep the momentum going! #WomenInLeadership #DrivingChange #Empowerment #PublicSectorLeadership

INSURANCE INSIGHTS | The recent decision in AAI Limited v The Owners – Strata Plan No 91086 [2025] FCAFC 6 has dismissed an application for leave to appeal a previous decision which allowed a liability insurer to be a defendant to proceedings concerning allegedly combustible cladding. Importantly for insurers, the decision leaves open the proposition for final determination that removal of allegedly defective ACP cladding may constitute an occurrence of property damage sufficient to trigger third party liability policies in place at the time the cladding was installed. Elizabeth Brookes and Kate Witt provide this case update. Read more: https://lnkd.in/gb2SHJcX #insurance #construction #cladding #liability
