A new casual employee definition and pathway to permanent employment now applies to all casuals employed from 26 August 2024. Under the new definition, a casual employee is someone who: - starts employment and has no firm advance commitment to ongoing work, and - is entitled to a casual loading or specific pay rate under an award, enterprise agreement or employment contract. The employee choice pathway to permanent employment allows eligible casuals to notify their employer in writing of their intention to change to permanent employment. While it’s not mandatory to show leave balances on pay slips, it can limit questions from staff about how much leave they have. Remember, if an employee asks how much leave they’ve got, you need to tell them. Most awards say you must be paid your final pay within 7 days of your employment ending. Your enterprise agreement or employment contract can also say when it’s due. If yours doesn’t say anything about when it must be paid, it’s best practice for your employer to pay within 7 days of you finishing up. FACT: Your employer can usually ask for evidence for as little as 1 day or less off work. If you don’t give evidence when asked, you might not be paid for the sick leave. Medical certificates and statutory declarations are examples of acceptable forms of evidence. More info about the evidence requirements for sick leave: https://lnkd.in/dbajpy9

❗REMINDER ❗ Changes to workplace laws start on 26 August. They include: • new definitions of ‘employee’ and ‘employer’ • changes to casual employment and conversion • a new right to disconnect (this change takes effect for small businesses on 26 August 2025) • new minimum standards and protections for ‘employee like workers’ in the gig economy and contractors in the road transport industry (regulated workers) • additional rights for workplace delegates who are regulated workers. While casual employees don’t get guaranteed hours each week, some awards/agreements set minimum lengths for casual shifts. These ‘minimum engagements’ can be set as a minimum number of hours or a minimum amount of pay. For example, each casual shift under the Fast Food, Hair and Beauty or Real Estate awards has to be at least 3 hours long. If it’s shorter, the casual still gets paid for 3 hours.
