  • FIAPO, along with local activists, is trying to file an FIR for cruelty against a baby camel that led to his death. It’s been 10 days since we were notified of a cruelty case concerning a baby camel in Ghaziabad. The camel had been used for joyrides in the Ramlila festival, blatantly violating the rules and the load-carrying capacity of the animal. A local activist had reported that the well-being of the camel was compromised despite being unwell for days. No medical care, food, or attention was provided to him, which eventually led to his death. We proceeded to intimate the police to register an FIR against the perpetrators under Section 325 of The Bhartiya Nyaya Sanhita,2023, and Sections 11(1)(a), 11(1)(b), 11(1)(h), and 11(1)(l) of the Prevention of Cruelty to Animals Act, 1960.  Ten days have lapsed since this heinous incident, and an FIR has still NOT been lodged by the police in this cognizable offence.   • 'FIAPO has written to the NCRB (National Crime Records Bureau) urging them to include detailed data on sexual crimes against animals in their reports. After FIAPO filed an RTI, it was discovered that there were crucial omissions in the NCRB reports (which we are hoping will be corrected). Currently there no record of the official data of several crimes such as 1. Sexual abuse of animals 2. Animal rape 3. ⁠General cruelty under the PCA (Prevention of Cruelty to Animals Act. Even though section 377 of the IPC is _completely omitted_under BNS Act, 2023 there are no record available of earlier cases filed under 377 (which includes _animal rape_).  A report titled ‘Sexual Crimes Against Animals: Excerpted from In Their Own Right: Calling for a Parity in Law for Animal Victims of Crimes’ documented 1,000 cases of assaults on animals. This report depicts that out of the 1,000 cases mentioned, 83 were cases of sexual abuse. Research also shows that violence against animals often correlates with violence against humans — a relationship supported by empirical evidence.   • AfA’s (Asia for Animals) Social Media Animal Cruelty Coalition (SMACC) has released a report called ‘Spot the Scam: Unmasking Fake Animal Rescues’ documenting the dangerous phenomenon of “fake animal rescue” content on social media. The report (https://lnkd.in/ezpjJmUU) calls on social media companies to take steps in tackling fake rescue content on their platforms. It also aims to raise awareness with the public and animal lovers, to ensure they are not exacerbating the problem, by falling for fake rescue content, generating views in the millions for fake rescue content creators.  Fake rescue content features animals who have been harmed or placed in dangerous situations specifically so that the content creator can appear to rescue the animal from that situation to generate revenue from "likes" and "shares", as well as from direct donations from the viewer. SMACC, made up of 29 animal protection organizations, conducted research into the online trend of fake rescue content. It found: • 1022 links showing fake rescue content were collected over six weeks from Facebook, Instagram, YouTube, TikTok, and Twitter/X. • The links located by SMACC had been watched 572,013,959 times. • Almost 52% of links were found on Meta owned platforms, Facebook and Instagram, with YouTube and TikTok each featuring around a quarter of total content. • 21% of fake rescue creators asked viewers for donations under the guise of helping animals, usually by Paypal links. • Cats were the most featured animal, in 42% of videos, followed by primates, dogs, snakes and turtle species. • From the 605 links that SMACC gathered, almost 22% of the content was suggested to our researchers by the platform's algorithm. Fake Rescue content shows animals in situations of immense danger; abandoned on the streets, buried alive or trapped in objects, being attacked by predators, and in need of medical attention. The report encourages the public to Remember A.R.C, when assessing potential Fake Rescue content: Authenticity - Always check the source! - No genuine animal organisation associated/Account has multiple fake rescue or similar videos/No follow up on what happened to the animals/Unprofessional rescue or vet practices/Human rescuer is always the same person Reality Check - What is really happening? - Unlikely to be a random encounter caught on camera/The same animals appear in multiple videos Creation - How the content is created - Creator delays assisting the animal to film the situation/Clear editing of videos & multiple camera angles Unscrupulous social media creators are putting animals at risk for clicks & donations via “fake rescue” content! Social media platforms must acknowledge this disturbing trend & regulate such content.   • Following the tragic death by fire of an ailing 54-year-old elephant, Subbulakshmi, animal rights organisations, including FIAPO, have issued a joint call for an end to the practice of keeping elephants in temples, appealing for their replacement with mechanical alternatives. The letter, submitted to the Minister of Forests and Minister HR&CE (Hindu Religious and Charitable Endowments), references the horrific death of Subbulakshmi, in Shri Shanmuganatha Peruman Temple in Tamil Nadu. The elephant was chained and hence could not escape the roof fire that reportedly led to 30% burn injuries, leading to her death. Incidentally, serious concerns regarding Subbulakshmi’s physical and mental health, poor daily upkeep and a request for urgent retirement on compassionate grounds were raised by concerned persons as early as 20th December 2021.Had the elephant been rehabilitated, this incident would not have occurred! While the fire may very well have been an accident, her death was wholly avoidable as real elephants are not required in temples, whereas they are necessary in jungles for a healthy ecosystem. It must be noted that in 2023, Madras High Court had directed the Tamil Nadu government to take a call on shifting all captive elephants to rehab camps, however a stay was later obtained. Encouragingly, in the recent past, a few temples have adopted life-size mechanical (robotic) elephants, where rituals are performed without cruelty to the elephants. The joint letter cites several other examples of tragedies befalling temple elephants and proposes the following sets of four urgent demands: 1. A formal Prosecution Offence Report (POR) must be registered under the Wildlife Protection Act. An FIR must be registered under Section 11 of the PCA Act; and Section 325 of the BNS. 2. Entry of any new captive elephants into Tamil Nadu must be suspended immediately. 3. On the heels of the recent Kerala High Court order dated 6th September 2024, the Tamil Nadu government should permanently disallow any increase in the captive elephant population in Tamil Nadu. Instead, focus on phasing out and rehabilitating the elephants already present in Tamil Nadu in facilities where they can live unchained, be handled without weapons, and live in the company of other elephants. 4. Finally, the TN Forest and HR&CE departments must commit to an urgent plan to phase out live elephants in temples, retire all existing elephants in natural facilities and move towards the bright, cruelty, torture and incident free future of using robotic elephants or other non-animal means.
