Alberta’s First Application for Streamlined Trial Fails The Court noted that the party applying for streamlined trial has the onus to establish that the streamlined trial process is necessary and proportionate. The Court noted that the test for streamlined trial is different than the test for summary trials was: [19] The test for a streamlined trial differs from the test under the old summary trial rules. A summary trial could be granted where the court was satisfied that it could decide disputed questions of fact on affidavits or by other proceedings authorized by the rules for summary trial and where it would not be unjust to decide the issues by way of summary trial […] [20] The test for a streamlined trial is no longer whether the matter can be decided using a streamlined process; it is whether it is necessary to use a streamlined process to have the matter fairly and justly resolved. The use of the word “necessary” in the new streamlined trial rule reinforces that the default process will be a regular trial unless the party moving for a streamlined trial is able to establish that the streamlined process is required or essential for the action to be fairly and justly resolved. https://ow.ly/YIoK50SxWRE Sometimes getting to “DONE” is as simple as coffee & conversation. Today the Standards and Regulation Board (SRB) is launching an important consultation where we are seeking the views of RICS members and the public on the right framework to support the ongoing competence of RICS professionals through continuing professional development (CPD). CPD is an essential tool for public confidence in the profession and to ensure members remain fit to practice by continuing to develop knowledge and skills as industry practices change and develop. It also plays a key role in career development and the steady improvement to standards of practice. We have a current framework which has worked well for over a decade and requires a number of hours of CPD to be recorded each year. However, we believe that regular review helps to ensure continued relevance, so we have asked a steering group to review this framework and consider if it needs to be updated in the light of developments and expectations over that time. The Steering Group, ably led by Peter Smith, FRICS, has spoken to RICS regional boards across the world, surveyed members and looked at other professions. They have developed a set of proposals for change on which the Board now wants your views before we make any final decisions. I stress that the SRB recognises the importance of the support of the profession for any changes to CPD, so this consultation exercise is exactly that; and if we decide to make changes, these will not take effect before 2026. 🏗️The Construction Leadership Council (CLC) sets out its ambitious delivery plan for 2024 👇 Preparing industry for the Building Safety Act, improving productivity, reducing carbon emissions and supporting biodiversity will be the priorities for the Construction Leadership Council in 2024. The Bi-annual Report of the Council also highlights key outcomes delivered by the Council last year, including: ✅ New competence frameworks for roles required under the Building Safety Act; ✅ The launch of a strategy to eliminate the use of diesel by much of the sector; ✅ Consulted on a biodiversity roadmap; ✅ An updated PAS 2080, including guidance for buildings alongside infrastructure ✅ Established an expert group to take forward the development of the Information Management Mandate (BIM 2). The CLC also successfully made the case to protect tens of millions of pounds in R&D tax credits that had been in jeopardy because of proposed HMRC rule changes late last year. Following CLC intervention, the new approach will ensure that genuinely innovative construction businesses can continue to claim this vital tax credit, helping to support a more productive sector. Good to see the disproportionate power of the "shadow public service" of consulting firms being recognised in the Australian senate this week, and a recommendation that when contracting to government they should be required to act in the public interest. This should be a bottom line here too. The report says "Increased use of consultants has limited the capability growth of the APS, given rise to occasions of serious conflict of interest, and been accompanied by questions about transparency...."It has also resulted in enormous costs to the APS for work that is often opaque and, in some instances, raised genuine questions regarding value for money." What can we do? I really like this innovative and practical move from the Australian Public Service, which has been willing to reach across agencies to set up an inhouse consultancy so that agencies that have specialist skills and experience can share that on a consultancy basis with agencies that need it. We like to think of ourselves as innovative and nimble here in NZ - we can do this too!
