On December 5th, 2023, co-managing partner Joshua Kimura participated as one of the speakers on a panel that discussed key learnings of litigating a recent AAPI Hate Incident in Irvine. The panel discussion was led by the survivor of the incident and the leading attorneys on the case to share insights with those in the legal community. The event was proudly hosted by the Orange County Asian American Bar Association (OCAABA), The Alliance for Asian American Justice, Orange County Korean American Bar Association (OCKABA), and Gibson Dunn. Thank you to all those who helped make the event possible, and thank you to those who decided to show up for such a meaningful discussion.

In the Land of the Will, Clarity is King. Your will is probably the most important document you will ever sign, and a recent Supreme Court of Appeal (SCA) decision confirms once again how critical it is to ensure that it is professionally drawn to reflect your wishes clearly and unambiguously. Let’s explore the legal principles involved and the “golden rule of interpretation” in the context of a bitter dispute between a financially-struggling widow on the one hand, and her three step-children on the other. Each contended for a different interpretation of the will, and the Court had to decide which interpretation correctly reflected the deceased’s intentions. Read more: https://buff.ly/4aSBTvo

Our journal (AAPJ) is available on CanLII! This paper by Vanessa Slater highlights how the retributive focus of the colonial legal system results in much trauma, particularly with respect to criminal justice. Viewing conflict through a relational lens which embraces principles of restorative justice supports relinquishing control over the achievement of “justice” and instead focusing on restoration. Vanessa's paper considers the relevancy, advantages and challenges of shifting Canada’s criminal justice system toward emotionally intelligent approaches. The fall is a busy time - but not too busy to miss this great event with a fantastic line up, hosted by my wonderful colleague at the The Bar Association of San Francisco Laura Benghal and the inspiring Donald L Proby. We in the dispute resolution field know very well that increasing #AccessToJustice is indeed about those infrastructural questions like price, timing, and technology. We also know that procedural justice (i.e. how participants participate in and experience the process of justice) has a tremendous role, big enough to sometimes overtake the power of outcomes. That's exactly why after mediating an issue, parties can and do often walk away satisfied with the process even when they did not secure the agreement concessions and terms they hoped for. In the realm of procedural justice, topics like love, compassion, mercy, and freedom often become paramount for parties. Yes, some may find it strange to connect these topics to the practice of law which to many appears dry and unambiguous. If that's you, I especially encourage you to attend this event!
